I think you know what I mean. I feel sorry for him in the way his name was used by some, but wish him well in his real business away from parking matters.

I recently won a similar case against VCS - I had paid for a ticket but allegedly breached one of the conditions.
What surprised me most was finding out that VCS did not get the parking fees from the machines on site - these went to the site owner. VCS had a contract with the owner to obtain income from issuing PCNs for so-called breaches of contract. So that's why these companies write so many rules, are aggressive about policing them, and appeals fail. Appealing to the site owner might not work because, in my case, the owner had to pay a fee for requesting VCS to cancel a ticket.
The PCN is simply an unsolicited invoice for damages relating to an alleged breach of one of the terms of a contract that you probably didn't realise you had made. If it goes to court, I'm sure that the judge will place greater weight in fact that you paid - which they cannot dispute - that any claim for a trivial error. That was my experience.
If you have the energy, make life tough for them now and don't be intimidated. Good luck.
So how can a defendant find out this info and then include it in their defence or WS, I am sure in the CoP it states that the Parking Company should not indulge in "predatory tactics" so i would think this would be classed as predatory.
I would have thought this "commission only" type of revenue is breaking some sort of law!!!

Every PPC operates like that. None charge, and they openly advertise that on PPC websites if you read the blurb as if you were a prospective landowner thinking about using their 'services'.
This is part of what is fundamentally wrong with this industry. It's a protection racket and should never be offered free (some even pay a percentage of the ill gotten gains to the landowner). The whole set up is a.rse about face.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
