Parking fine ignored now ccj

Hello all,
Well Iv joined the parking fine club,
In 2015 I paid for 24 hours in a car park. I only actually stayed for 4 hours and came back to my car to someone photographing my vehicle and noticed a penalty stuck to my screen.
I argued that I had a ticket paid for 24 hours to which he replied I had parked in a numbered bay.
The number was on a wall at knee level height and not clearly seen at night time which is when I parked.
I only saw a big banner saying the deal for parking for 24 hours and an arrow pointing to direction my car was parked in.
Looking further on a really small sign in tiny writing at the bottom it told me no parking in numbered bays.
I think this is so misleading with the sales sigh pointing to the direction of the spaces I parked in and i paid for the ticket.
Iv been on deployment with the army and back a week ago and received a letter saying I must pay £277!
This letter looks basic though and is from county court business centre and with it a bw legal specialist recoveries letter the day after stating I must pay or ccj . Has anyone been in this position and what’s my options ? I’m 27 and just getting my first mortgage sorted to move home and this is going to cripple me.

Have you received a Claim Form from the County Court Business Centre or a Judgment for Claimant (by Default)?0
-
follow the instructions in post #8 of this thread
https://forums.moneysavingexpert.com/discussion/5910779/minster-baywatch-2x-parking-fines-help
ie:- redact the letter, upload a pic to tinypic and add the dead URL to your post in your reply
let us see what you see, minus the personal info including redacting the reference and VRM etc, as well as your name and address
its the rest we want to see, so careful redacting and showing us is best0 -
Did you ignore court papers? The poll is completely unnecessary as the advice on here has been not to ignore since 2012.0

Yes I have a basic letter titled judgment for claimant ( in default)
It’s dated 08 oct 2018
But it looks like very basic I showed a friend and they said the stamp doesn’t look like a real stamp.
I called the number and it’s 0300 123 1056
And that seems to check out though.
I just don’t understand how a privately owned park site can get m automatically a ccj ? Surely I must be able to appeal with out paying £255 fee.
I feel this is unfair as I paid to park in a car park for 24hrs
And the penalty seems unfair as it’s not clearly stated. This is going back to 2015 I can barley remember it.
I still have my parking ticket in my glove box in my car as I kept at the time due to me not accepting a ticket for a 24 paid permit.0 -
Sorry I am new to this the poll I couldn’t get rid of. And didn’t want to lose my post.
I tried to upload a photo and it said I’m too new a member or something il try again0 -

Unfair as it may seem to you, the reality is:
1. Pay it by the deadline set to avoid the CCJ.
2. If you want to apply for a set-aside, it will cost you £255 (but some concessions to £100 if you're on certain benefits), BUT you need to have valid reasons why the court claim was not acknowledged or defended. Some of the reasons you state above are unlikely to get a Judge to agree a set-aside, then you'll have lost your £255 and you'll still have to pay the default judgment. But being away with the forces might have some traction.
3. If your credit rating is of no consequence to you, you could ignore this, but the claimant could apply for enforcement against you, then you could be getting a knock on your door at 5:30am from a man with a clamp in his hand.
Are there any reasons why you didn't defend this? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

That is real paperwork from the court. It means you failed to respond to a claim so judgement has been entered against you automatically.
You now have a few options. If you didn't get the paperwork (for example you've moved house and it went to the old address) then you can apply for a set aside which is indeed £255. You can often get this back if you win.
If it is within one month of the judgment then paying it in full will result in the ccj being removed.
Let us know what you decide. You still need to jump through a couple of hoops with either option and you don't want to mess this up.0 -
