  • Thankyou everyone for taking the time to help me with this.
    I believed this letter was legit it was a parent who said they thought it was another ploy to get me to open my pocket.
    I wanted to ignore the company letters till I was forced to by the govement, just the injustice of actually paying for a parking ticket 24hrs and then having a penalty in the car park for parking in an empty bay with a number on it only to see in the fine print smaller than this writing that I cant.
    It’s just made me really angry as £277 is a lot of money for me at this time.
    But I want to thank you for your advise.
    My parents didn’t think this letter had to be paid, the laws changed a think as someone says in 2012 so they didn’t concern me with the letters while I wasn’t out of the country.
    I’d of ignored them anyway as I didn’t think a private car park could have this kind of bill against me, silly me...
    I think I’m just going to be stung and pay up....

    sorry to say that this has nothing to do with POFA2012

    the small claims court system came into being in 1973, long before you were born, this CCJ is a result of not dealing with it promptly and listening to bad advice from people who know nothing about it (sorry to say)

    I realise you were away serving the queen and country and do sympathise completely

    even MP,s think this is a sc@m , so watch the videos and gen up on it

    but as this is a default CCJ its either fight or pay

    if you pay promptly , it will be removed by the claimant

    if you fight , a judge may remove it, and you may get your money back if a judge orders it

    I sugegst that you get somebody you can trust to deal with your mail in future and get them to act on it, not to make assumptions and if in doubt go to a parking forum or legal forum to see if things are real or not

    a harsh lesson I know, so I do sympathise as its a lot to take in

    but its the civil justice system, not parking per se

    For a single claim £277 is well over the top, had you have defended and lost the most a judge woild have been unlike yo award the PPC more than £200. They are adding charges which the law does not allow which, imo, is unprofessional conduct.

    I would complain about these charges to their regulatory body the SRA

    From the letter you received from the creditor you will know you now have a CCJ registered against you, and that irrespective of you paying it off during the month following the date of judgement the claimant won't inform the court of receipt of your payment.

    So if you do pay it off then do get proof of payment as it will be down to you to get the ccj removed from the records.

    Make sure that they get cleared funds before 7/11
  • I thought I would get the ccj if I ignored this letter. I think I have a month to pay off the charge and then I will not get the ccj ?

    It’s very confusing to me as I thought anything like this I would be able to go to court and defend myself.

    I really can’t risk losing after paying £255 to dispute and further paying £277 for the charge.

    I don’t want to waste anyone’s time but I just can’t justify £277 for a parking fine for being in a numbered bay it seems criminal to me ? I don’t understand what the fee is suppose to cover.
    And why it cost £255 for me to dispute the claim.

    This is the first time I have ever had anything like this so it’s all very new to me but I am doing my research to brush up on this.

    I would be upset for anyone like myself to be in these circumstances.

    its because the court claim was issued and nobody defended it (you)

    the claimant has bumped up the costs from £100 by adding court fees and legal fees and probably debt collector fees onto it, without an objection by you

    a set aside is £255 no matter what the issue is, it could have been a garage bill for repairing your car , or a plumbers bill for fixing the boiler

    the chances are that because you are employed you wont get legal aid, so no free or cheap set aside

    yes its a lot to take in, but once these sc@mmers do this its hard to reverse (but not impossible)

    if this had been a council pcn and was unpaid, it would have gone to mags court etc and the costs can easily escalate, especially if they get bailiffs in

    the same could now happen to this one if it remains unpaid, and after one month (say 30 days after the judgment date), it remains on record for 6 years and trashes your credit rating, hence why you must pay it off quickly, or fight it quickly with the £255 fee and form for a set aside

    look at the MCOL website, it explains this civil court claim system etc

    the parking charge led to the court case, not replying and defending made the default CCJ happen

    although its complicated , we are giving you the basic facts, facts your advisors should have known due to the fact its been a system for 45 years, not the last few years


    complain to your MP, it wont change until the MP,s change it
  • Yeah I understand it’s a lesson and a mistake I won’t make again..

    In future I’m just going to pay the extortionate price I’m billed so it doesn’t get to this stressful situation.

    I wish I could defend myself against this being away from home and actually getting a ticket to park my car in the car park that I still have but I feel the bill I’m getting now is for not acknowledging these claims for money from the car park.

    I just don’t have the time or money to defend myself on this one

    Cant believe it’s this easy to get money out of someone.

    I will complain to my MP and contact the SRA

    Just so my fee isn’t for nothing.

    you are welcome, we hate these sc@mmers and how they misuse the law

    bear in mind that ANYONE can issue a court claim against you, for anything they wish , if it is not defended then the same default CCJ would happen

    its an easy trap they are exploiting by using private parking and cheap DVLA access to make thousands or millions

    if you get any more parking charges , come here asap for advice

    you may think you wont , but these par@sites infest hospitals , doctors surgeries , retail parks , leisure parks, train stations, airports , ports , supermarkets , all sorts, almost impossible to avoid them

    You now have a CCJ registered against you!


    It goes on the register of CCJs immediately (check for yourself at the trustonline website) and will have been passed to the credit ref agencies




    If you pay it off within the month, then you can get the CCJ removed from the register as advised in #15 above


    (You say you don't have the money to pay it off, but bear in mind the creditor can enforce a CCJ (eg attachment of earnings/bailiffs etc). An alternative is to arrange to pay it on the drip, though that will mean it stays on the Register for the 6 years)

    as Quentin says above, its not about getting a CCJ, you already have a CCJ from the date of the judgment


    its getting rid of it within one month and getting the claimant to tell the court that its been paid IN FULL and to remove the CCJ from the register that you need to get done , otherwise its on there for 6 years

    your credit rating is already trashed so the only way to fix that is fight or pay , if you choose to pay it needs doing promptly, time is ticking , its a short deadline , then its a case of ensuring that the CCJ is removed from the register, that way the credit rating is restored

    this doesnt "go away" until the court is told and the CCJ is struck from the register (which is where it already is - its not going on in a months time, its already there , its waiting for action or inaction with a 30 day or so deadline - or one month to be pedantic about it)
