I am scared. Please help. UKPC requested driver’s details before appeal decision can be given.

    Hi all,

    I am a little perplexed.

I received a letter saying I must give them the name of the keeper. That was end of October. I didn’t reply. 6 weeks later I haven’t heard a thing.

    Is this normal?
Your opening post, 17th October, told us they were asking for the driver's name and address.

Is this a new letter you have received? One asking for the name of the keeper?

The Registered Keeper and the driver are different people. If the vehicle is registered in your name, you're the Keeper and that's that. Usually you should not reveal who was driving.

It looks to me as if you blabbed about who the driver was in your original appeal. Is that the case?

If the parking event really only lasted 5 minutes, it's hard to see a court finding in favour of UKPC. But I do not have a lot of experience. This may fade away, but it may not. I'd recommend keeping in touch with this site, give clear details about what is happening but do not reveal the identity of the driver. Could be that you have a bit of an ongoing 'situation' to contend with but I bet you can find your way through with a bit of help.

Can you edit your first post to hide the identity of the driver?

Complain to the BPA that you have appealed and not been given a POPLA code. Tell them you want their member sanctioned.

    Transfer the scardiness!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Do not be scared of UKPC, they are fraudsters, and judges are aware that they have form. They would have a mammoth struggle to win a case in court against you for breach of contract in the circumstances you have outlined.

Read the BPA ode of Practice WRT grace periods.

Read the BPA Code of Conduct wrt grace periods.

Why not complain to your MP? MPs are getting thousands of letters about these companies issuing unlawful tickets and a Bill is with the House of Lords tp curb their excesses as I write this.

Double check everything you have received so far, and please also confirm what you put in your appeal.

If you are absolutely sure the scammers received an initial appeal from The Keeper, they don't know the driver's identity, and you have not been given a PoPLA code, then you should complain to the BPA and DVLA.

When you eventually appeal to PoPLA, you will at least have inadequate signage and lack of grace periods as winning appeal points. This can be found in post 3 of the NEWBIES.

Has The Keeper complained to their MP yet about this unregulated scam? You must do this.
