Just writing this thread as it may be useful to some, like myself, that have received a ridiculous PCN for a parking breach in a store car park and don't have a legitimate reason to appeal.
Firstly thanks to all previous contributors, as that gave me some very useful information, particularly in the Newbies thread.


I recently received a PCN for parking in a disabled bay in a small Tesco Express car park without displaying a blue badge as I don't have one. I'd done this a handful of times before over the years, when no other bays were available, but was unaware that Tesco had employed PPS (UK) Ltd to control their car park.


Anyway, my initial appeal with PPS obviously failed, as they are just money grabbing cowboys that hide behind the delusion that I MUST have seen the signs and therefore a contract was formed. I'd given 3 reasons in my appeal, none of which were considered (R1: I hadn't seen the signs as they weren't clear on my route into the car park and my 5 pace walk from car door to store entrance R2: disproportionate charge £60 rising to £100 and R3: mitigating circumstances as I was quite ill at the time, recently having blood transfusions, and was only in the store for about 10mins)... anyway, all were rejected.


My next step was to complain to Tesco customer services who came back with that old excuse that they don't own the car park, they only lease it, and have no say in the matter and that I would need to appeal to PPS.


My final approach was to write an assertively worded complaint letter to Tesco CEO, pointing out the facts, stating I did not believe Tesco had not appointed PPS, complaining about the aggressive and intimidating nature of correspondence from PPS etc and that I felt harrassed....I gave them my club points number as an indicator of how much custom I'd given that store over the years and bluntly pointed out that I would not continue giving them my custom unless the situation was resolved.


That seemed to do the trick... just had an email from Tesco CEO office advising they had 'reached out' to PPS to have the PCN waived as I was a valued customer... with a little bottom slap not to do it again... Thank you Mr Lewis (Tesco CEO):j


Anyway, my view is that unless you have a legitimate reason why the PCN is not valid, in most cases you are probably wasting your time going through the appeal process with the company that issued the PCN and probably also POPLA as they will only look for legitimate reasons... and both will deem you to have entered into a parking contract providing signs are clearly displayed regardless of whether or not (like myself) you saw them. Just go straight to the top, and hopefully eventually the message will sink in that valuable customers will not tolerate this nonsense!!

    Always complain to the Retailer very quickly and assertively, WITH A RECEIPT IF POSSIBLE

    Regarding Tesco, you were lucky because most
    letters going to Dave Lewis are passed to his so
    called executive office who back parking companies
    and not customers.

    Tesco's customer service is terrible and once bitten,
    customers don't return.

    Those thinking of shopping at Tesco should think twice
    as their customer service is the pitts and they support
    the parking scammers

    TBH, your post in there will be and remain much more useful to many more people than on a thread that once it has dropped down the board, may only be occasionally bumped by a hijacker who has utterly failed to understand the difference between a cancellation and a live ticket.

    but I have to say that behaviour such as this is one of the reasons the companies employ PPC's .........

    you will get caught sooner or later if you persist ... your choice ...

    If you are ever in the unfortunate position of needing a Blue Badge, then let us hope you don't come across selfish drivers such as yourself.

    Or indeed don't have a blue badge but are disabled and need to use a designated disabled bay.

    Perhaps you should read the post properly before making pointless rude comments... sounds like angry_parkers health wasn't good (having blood transfusions) .... I've had to do this myself before when I had a busted leg. I'm not a blue badge holder either but guarantee I was more needy of the disabled space at that time than some blue badge holders I've seen before!! Many occasions I've seen a car with a disabled badge pull into a disabled bay and the driver clearly has no disability whatsoever, and they have no disabled passenger either.

    You are making a dangerous assumption,!

    Not all disabilities are obvious!!

    I've had to do this myself before when I had a busted leg.
    With such a condition, should it not be likely to last more than 12 months, the Equality Act 2010, which extends well beyond the Blue Badge scheme, would not provide you with any legal support should the Landowner pursue some kind of court case against you.

    Very difficult for them to do, but just a heads up to you so you aren't misunderstanding the full legalities of this. Read up on the Eq Act.
