30 mins free ticket

Hi there, I've received a parking fine from Britannia parking. I've paid for parking right up to a half hour before their parking ban stops. They offer a free 30 minutes ticket but as I was at work and hadn't received anything from them before during the other times I figured this is their logic too. I've appealed my fine and they said as I only paid until 29 minutes before the parking ban is lifted that I am in breach. They are not deemed to make anymore money off me if even I printed a free 30 minutes ticket. Do i have a leg to stand on?

    I hope you haven't used your real name as your user name. If you have, you should send a PM to a board guide and ask them to change it.

    Start by reading the Sticky thread for NEWBIES that tells you all about this unregulated parking industry.

    Did you reveal the driver's identity when you appealed? I suspect you have unfortunately. If you haven't, then you should edit your post to remove information abut who did what. Only refer to The Driver and The Keeper, who are two different people.

    Did you get a PoPLA code with your rejection? If so, you should use it. Read post 3 of the NEWBIES and construct a draft appeal. Post it here for checking before you submit it.

    I don't entirely understand what you are saying The Driver did. Images of the signs would help.

  • The driver parked the car at 331pm and paid for parking until 731pm. The parking ban in the retail car park finishes at 800pm. The retail car park offers 30 minutes free throughout the day. The driver didn't have time to get a 30 minutes free ticket to put on windscreen but received a fine. The driver has appealed but was rejected. A code was issued but the driver ignored the code Unfortunately and didn't see the popla procedure. The keeper has sent 2 debt letters since. Does the driver have a case?

    You haven't said whether the PPC know the identity of the driver, but if they do, and the PoPLA code has expired, then they are in ignore mode unless they get real court papers.

    If The Keeper is getting debt crawler letters then I suspect they are out of time to appeal if the PPC don't know the identity of the driver.

    To whom has the keeper sent the letters to?

    Did the driver appeal?

    Whoever ignored the popla option now is in the debt collector,/wait and see stage

    Ignore everything except a lbcca or Court correspondence

    They have 6 years to start legal proceedings

    If it comes to this then the recipient should come back here for advice on how to defend this
  • you are required to obtain free ticket , or pay within the grace period , this is usually 10 mins after arrival

    did you obtain free ticket or pay within 10 mins of arrival ?
  • The driver paid up until 731pm but couldn't get a ticket for 30 minutes free but as the retailer doesn't charge after 8pm it should be considered irrelevant as they are not deemed to receive anymore money to pay for parking.
  • The driver did appeal and was given a response.

    The keeper is the drivers partner

    The driver used his name in the appeal letter.

    The keeper has been sent 2 debt collector letters

    The popla did expire before the driver or keeper realised to respond.

    Does this make sense?
  • as stated before the parking co adhere to the BPA code of practice that states a "grace period (typically 10 mins) to decide to stay or indeed leave the car park

    you seem not to have got/bought a ticket within this time and there automated system has picked up on this

    you were correctly given the option to appeal using POPLa , but you missed this

    it seems that you fail to do things in a timely matter


    fight them in court if you wish

    SO, a simple answer to the question: do they know the identity of the driver? woudl have been YES

    If they know the identity of the driver, then its pointless talking about driver / keeper

    You are in ignore mode it seems, EXCEPT for a LBA or a County Court claim form. You will, by reading the NEWBIES thread post 2, be entirely cogniscent of what those are.

    Fail to deal with those in time, and you will have a CCJ to deal with.
