    The regulars will guide you through, you have nothing to worry about, I hope you are reading lots though regarding court claims/procedures, what to do and when to do it.

    It doesn't work that way.

    Now you need to crack on and compile a Defence.

    You have around three weeks to do that.

    For ideas you might want to read those Defences linked from post #2 of the NEWBIES FAQ sticky thread.
  • Thanks for the quick reply and I understand that the experts on here dont want to spoon feed me but I just want a professional response to this court claim and dont want to write something amateur.

    I will be looking into more and more information over the next few weeks to build up hopefully a good enough defence to fight this.

    The NEWBIES thread has a section in the 2nd post: KNOW WHAT HAPPENS WHEN.

    Please read it, then read the example defences there too, as you DO NOT get anything back at this stage - the ball is still firmly in your court and the defence clock is ticking (but you've extended the defence time by acknowledging).

    Once you've read example defences in the NEWBIES thread you will see a clear pattern (albeit mine are long and bargepole/Johnersh's are short).
    Who are the 3 solicitors and how can i get help from them?
    There are 2 solicitor posters and they might comment if and when you show us your draft defence like everyone else does. There is also bargepole who is a GCilex which I believe is the equivalent of a masters in law. And IamEmanresu is also a Cilex, not sure if the same as bargepole but both are VERY knowledgeable people who post here.

    You cannot contact the legally qualified posters directly and your case is exactly like all the rest, so you do not need one-to-one advice at all - but on this forum is where you will get the best help and advice. Believe me, your defence WILL be good!

    Look how quickly we are all replying to you, we want to help, and we know what we are doing, hence the NEWBIES thread being pinned at the top for people just like you.

    You have a couple of weeks to play with some defence wording & show us (up to 33 days max from the date on the claim form, before you must then email the signed defence to the CCBCAQ email addy).

    Start reading defences when you can and keep an eye on your deadline.
    I just want a professional response to this court claim and don't want to write something amateur.

  • I got a questions, after looking through the correspondence via Email between myself and the debt collection company some time ago, I said that I was willing to pay the original fine but not the extra costs they were asking for, could they use this information against me by saying that I am admitting that I am guilty?

    No, you can ignore that and they are unlikely to even have that correspondence. Even if they did, an offer is reasonable and not an admission of 'guilt'.

    It is not an admission but can be persuasive to a judge. You can dispel the notion by having the facts of the event at your disposal.

  • Good afternoon, so I have been reading up on the newbies thread (there is so much awesome information in it) I think the best angle of attack is for me to point out the signage being somewhat too small to see from the road. Ironically they have taken a picture of my van with thre sign on the wall behind it. You can see the sign but its rather small and illiterate from the road. They have since put bigger signs up on the walls which are more visible so arguing this point might help but am currently unsure how to word this (i will keep looking) Now with them sending me a picture of the van and sign, could I use that as evidence against them or is it not recommended to use photographic evidence when it is originally used against me?

    The original invoice that they have send me doesn't specify if they are chasing the vehicle driver or vehicle owner, they just have my name and details on it which they got from my vehicle registration, is this another thing I can bring up? thanks

    They dont have to specify it, but in order to comply with POFA they have to warn the keeper that they can become liable.
