Court Claim by BW Legal

thanks for response, I have read a few of the threads on here already but am still head scratching with it all on where to start with mine. I may just put in my defence that I requested and didnt get a copy of the contract between the parties chasing me for the monies.
I may also put in my defence the fact that I never saw the PCN's on my windscreen, nor did I recieve and PCN's through the post but only recieved "FINAL DEMAND" red letters months after the incident.
They have photographis evidence of my vehical parked up, under one of there signs, on both nights with the PCN clearly visible so not so i have a leg to stand on.
I will just put about not getting the PCN nor copy of contract in the "defence" box and send it back0 -
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.
Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P.
for unprofessional conduct
Hospital car parks and residential complex tickets have been especially mentioned.
The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the House of Commons recently

and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas. You never know how far you can go until you go too far.0 -
How about you read proper defences, constructed well, and post here for critique?
As your plan is a foolish one, unlikely to succeed.0 -

REALLY ???? That will cost a lot and most solicitors
don't understand the scam parking industry.
Be patient, there are 3 good solicitors on here who
are clued up and they help you for FREE0 -

Don't be daft, come back when the solicitor can't help, or says you have no hope.
By contrast, we see 99% wins here!
Certainly don't go paying some 'appeals firm' (OMG...check Trust Pilot and addresses).yet non the wiser on what to write in the defendent boxwould I be best to put all that in the box where it says "Defence" on the "defence and counterclaim form" and send it back to Northampton county court?
Which parking firm, did I miss that?
Tell us when you've done the easy bit, the AOS on MCOL (NOT DEFENCE).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:

Having done the AoS, you then have until 4pm on Tuesday 30th October 2018 to file your Defence.
That's nearly four weeks away. Plenty of time to hone your Defence to perfection.
When you are happy with the content, your Defence should be filed via email as described here:
1) Print your Defence.
2) Sign it and date it.
3) Scan the signed document back in and save it as a pdf.
4) Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
5) Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
6) Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
7) Wait for your Directions Questionnaire and then re-read post #2 of the NEWBIES thread to find out exactly what to do with it.0 -
Who are the 3 solicitors and how can i get help from them?
When it comes to written out statements for court, it goes way over!!!! I have never had to do something like this before so have no idea where to start or what to say!
Or first off, I think the signage used by the parking firm was to small to be seen
Secondly I think that the claimant doesn't not have the right to issue the PCN on the land as he had no contract back in 2016 with the landlord
Thirdly, I never saw the PCN on my vehicle even if they are in the photos provided by the parking company and they did not send the PCN,s to me through the post which didn't give me a chance to appeal as it went up to £185, I also said to the parking company that I was only willing to pay the fines but not the added on fees but they declined and said that if i could prove from the post office that i hadn't received the PCN.s or letters before the fine went up to £185, then they are unwilling to drop the fees which I think is unreasonable
Can I write any of this in my defence box or will I just get laughed at by the court?
At least if i get a solicitor, they will know the exact things to write and not sound like a amateur at this, which I am0 -
"What is the problem with the defendant box? What do you mean?"
Sorry i ment the "defence" box on the "defence and counterclaim" sheet
"No, nothing about filling in forms. You just do the Acknowledgement of Service first, on MCOL, online. AN EASY STAGE. The newbies thread shows you how, in pictures (a Dropbox link)."
Ok so what you are saying is at this stage, I just need to fill in the "acknowledgement of service" online? because I will do that now
"Which parking firm, did I miss that?"
it is from Parking awareness services0 -
Oh please!!!! why don't you just ring up the parking scammer tell them your thinking of instructing a solicitor and will they accept £750 to settle their alleged scamming debt because that's about half of what it will cost you to get a solicitor to defend this all the way through.
Where's your fighting spirit, your not fighting a murder charge!!!!! even if you messed it all up and lost in court you would probably pay less than what the scammers are demanding AND it costs the scammers to take you to court!!!!0
