Garage has registered my car in OHs name

  • Seems pretty simple to me... (just a quick google away)
Fill out the form online for a lost/replacement V5.
Once you’ve received it... and its trivially simple to go onto the DVLA website and change owner (just as you would when selling a car), and there is not cost to do this.
Clearly you should only do this if you’re legally alllowed to
If the V5 was originally in your OH’s name & Address then you don’t need to contact the finance company.
Unfortunately there’s a £25 fee for replacing a lost V5 doc - so best course of action is to find it!

Why does it need to be in your name? I doubt the insurance company will care since the assumption is that you share assets. I'd leave the finance well alone, as already pointed out it's been put in your husbands name fraudulently to make the finance possible.

is it really that fraudulent if its a married couple? they share everything anyway.

not like its a parent for their child or a friend or something

I doubt they bother as the car would be a marital asset. My insurance company said it didn’t matter who’s name was on the log book when it’s husband and wife, just who drives it most. Main thing for the log book is who speeding tickets come addressed to.
Well it's not an asset though as the owner is the finance co. who, as has been stated, will very much care about who's the main driver. Also, don't forget most insurer's ask both who is the RK but also who is the owner.

Its not "fraud" per se - ie, noone will ever take you to court over it - but you're giving the finance company the impression that its for person X with a good credit rating, when its actually for person Y with a bad credit rating which they dont like - and i guess you can see their point.

The fact they're a married couple helps but it needs to be declared as 50% usage each if queried (very unlikely) to keep them satisfied.

Technically yes, it's being obtained for X on paper despite being for Y, because Y would be rejected. Intentional deception for gain.

Since they are married it's unlikely to be an issue as it's probably a communal car that's most likely used by both (assuming the husband drives). But finance companies insist on having the registered keeper being the same as the person with the finance, and doing otherwise would be a breach of the contract.

But because they are married, there should be no reason to change the registered keeper anyway, insurance companies don't care if it's owned by a spouse.
