Grounds for Chargeback Claim?
Seriously?!

in Credit cards
I don’t know if the rules allow me to post names of companies and individuals? I’ve read many on other posts so I’m assuming yes? No doubt I’ll be deleted If not.
I have a question about making a credit card chargeback claim.
My husband and I rented a luxury villa – Portal Hills Villa or Villa Portals Hills - via Kay Perry from ECvillas (Based in Mallorca and Ibiza) in September of this year. We paid 50% deposit in January via Mastercard. The 50% balance was paid via bank transfer in August. She was the agent, not the owner.
The villa was supposed to be a luxury villa. I know ‘luxury’ is a subjective word but in my opinion the most luxurious aspect of it was the price – an eye watering €13,741. There are way too many examples of why it was not up to scratch but here is a flavour:
It was booked for 12 people but only adequately slept 10 (2 people were expected to sleep on a dirty sofa bed in the hallway which had no privacy, no storage, a noisy fridge freezer, no bathroom – and the agent couldn’t assemble the bed in any case). We had checked before booking and were told the extra ‘room’ was a playroom.
The pool was dirty and dangerous. It was filthy. The water was opaque and riddled with dirt and debris – tissue paper, plasters, leaves, twigs etc. We had to ask that it was cleaned and then we were told we couldn’t use it for a further 24 hours – so that meant we had a sub standard/unusable pool for 3 days. A low glass partition (c.5”) was the only thing between it and a c.20’ drop.
The Wi-Fi only worked in the living room – despite it supposedly being villa wide. It was advertised as including maid service but there was none. There was no welcome basket of basics and luxuries. The kettle was dangerous (the stand alone base was flooded with water), no adequate kitchen bin, slippery flooring, missing items, insufficient items….so many things, far too many to list.
The agent was called out to discuss them but arrived with a few replacements and then disappeared! She later told us we should have “chased” her to follow things up. You can’t make it up?!
I have no photographs of any of our issues but I have got the agents written replies to each of my comments and several mealy mouthed apologies. The agent has advised us she has referred it to the villa owner (despite our contract being with the agent?) and the villa owner is not prepared to refund as I have “sent threatening emails” (I haven’t) and already put “negative comments on the internet” (When she had failed to respond to me after 1 week I did a review on ECVillas Facebook page which they removed within 10 minutes).
So my question is, does this sound like I have a chargeback claim? Any advice would be gratefully received.

Not really no.
You need to take it up with the agent/owner and pursue it that way0 -
Thanks for the reply !!!. I've already tried taking it up with them but they are not remotely interested - even though I have no doubt they'll now be actioning our - free - feedback! Surely it must be worth trying to claim?0
-
If it's surely worth 'trying' to claim, why are you asking here? Just try. Worst case is it gets rejected.0
-
I agree Potbellypig, I think it's definitely worth trying. I just wanted to know if anyone had had a similar experience and therefore any advice about how they went about it and what the outcome was.0

Another thing. Before I spend such huge sums of money I always do an online check against names/website details. Same if I buy a product via Amazon I like to read what other people have to say about a product before I buy it. There was nothing negative about this woman or villa or company. There is now so if anyone else does a similar check at least they have pertinent information on which to base their subsequent decision.0

Are they backed by any sort of guarantee at all?0
-
I'm not aware of any money back guarantee. I've checked the t&c's but there's nothing - the usual guff that is designed to protect them. Chargeback appears to be my own form of financial redress and tbh I don't hold out much hope for that - but the process will be cathartic for me and hopefully irritating for them.
The villa itself and ECVillas.com are not listed on TripAdvisor, TrustPilot or TurnKey so I can't leave a review - yet. But I have the time and inclination to watch and wait. If one day they do appear, my typing finger is well and truly ready. There is also an ECVillas Facebook page that I left a review on (they hadn't responded to an email after a week but funnily they did after I left the review - it was removed alas). I plan to leave more comments - which they can then remove of course, but then they have to remove their own content too.
There is also the Spanish Tourist Board. I don't see why they shouldn't be kept in the loop?! I've got my thinking cap on re other ways of shaming them.
I am just so frustrated that it is so easy to take peoples money and not give a rats bottom what is provided in return! I say there is always a consequence.0 -
When you say you paid by Mastercard....was this a credit or debit card?0
-
Hi BoGoF - it was a credit card.0

Hi mate
No this wouldn't be covered under chargeback. What you are looking for is compensation for the poor service you have received, which isn't something a chargeback can do. Its a really common query though but it wont get anywhere I'm afraid.0
