2 x Letter Before Claims - Vehicle Control Services

hi,

i am starting a thread as instructed in the newbie post.

the first LBC i have received does not provide a date for the charge notice, i has a code which is wrong and doesn't mean anything.

with the second one, it is all in order but they are demanding £192.43 for each offence! what a joke.

i was going to respond asking for evidence of signs and photos etc as instructed, is the the logical next step?

    yes, read a recent LBC rebuttal to either VCS or EXCEL etc and plagiarise it

    also add details of it being a SAR under the GDPR requesting all ALL EVIDENCE , DOCS , PICS etc too


    do one for each LBC, even if they are identical apart from the references

    I would not use a long template.

    When replying to a LBC just state what evidence you require to see, and if the driver has not been implied or admitted thus far, DON'T imply the driver's identity now!
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    For the lbc with the incorrect date reference, can I word that more aggressively to imply they are incompetent and that ticket is not valid?

    Just send the LBC rebuttals as advised, don't even waste your time telling them (aggressively?) their date reference mess up as they wont care, it is irrelevant anyway until you produce it as evidence in court, that's when you win.
  • Maybe aggressive was the wrong word, meant abrupt / sternly.

  • Hi guys, so had no reply, but received this claim form from the County Court today.

    However, I was very sceptical that all the watermarks are very low resolution copies and there's no wet ink anywhere! I've done some googling that suggests this is a fake letter. So surely its illegal to impersonate a court??

    What is the Date of Issue on your Claim Form?

    Can you please post the exact contents of the Particulars of Claim box on your Claim Form?

    (more particular masking of that image may achieve that)

    With a Claim Issue Date of 19th October, you have until Wednesday 7th November to do the Acknowledgement of Service, but there is nothing to be gained by delaying it. To do the AoS, follow the guidance offered in a Dropbox link from post #2 of the NEWBIES FAQ sticky thread.

    Having done the AoS, you then have until 4pm on Wednesday 21st November 2018 to file your Defence.

    Over four weeks. Loads of time to produce a perfect Defence, but don't leave it to the very last minute.


    When you are happy with the content, your Defence should be filed via email as described here:

    1) Print your Defence.
    2) Sign it and date it.
    3) Scan the signed document back in and save it as a pdf.
    4) Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    5) Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    6) Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
    7) Wait for your Directions Questionnaire and then re-read post #2 of the NEWBIES thread to find out exactly what to do with it.

    But I don't know if you saw what I put, this is a fake claim letter! (I think)

    It's directing me too the county court business centre in Northampton, not a county court. The address is money claims online, county Court bulk centre, nn1 2lh

    And, the watermarks are not legitimate they are ineligible photocopies, and again no wet ink signature. I can no imagine an official government document arriving like this?
