If what the adjudicator has said is correct then this case defaulting to the Ombudsman is going to be costly for me.

She's just trying to frighten you into cancelling the referral to the Ombudsman because she knows that the Ombudsman will be disgusted at the way she's handled your case. She just wants to bury it.

It would be worth answering her question about whether TSB has paid. Perhaps reminding her that her manager got in touch with TSB and advised you that they didn't seem willing to pay which was why you accepted the recommendation to escalate to an Ombudsman.

I spoke to her this morning, there has been nothing from TSB, however the adjudicator advised that this was due to me initiating Ombudsman action.

Seems unlikely to me, I'm not even sure that TSB would have any visibility of the case being reassigned within FOS, although would expect them to be notified once an ombudsman has actually taken it on.

I'd reiterate my recommendation from 20 February above, i.e. contact the manager that this was escalated to and find out what her opinion is of the adjudicator's conduct and what options you realistically have now. To me the manager should be making things happen and controlling the process, rather than leaving you in limbo between an incompetent adjudicator and an ombudsman to be appointed at some unspecified time in the future!

At the very least, if the adjudicator's recent research conflicts with the information provided to you by the manager, then that's something the manager should be made aware of.

I wouldn't be surprised if the FOS themselves made you a payment for their (mis)handling of the case. It would certainly be well deserved.

The £200 sounds like the adjudicator has become aware of something that may be trickling down.....

That's not what's implied (to me) by your earlier posting of her message, in which she claims to have "reviewed your case further along with comparable cases". This sort of approach is actually quite sensible....

....if she'd done it prior to adjudicating on your case last December, but not now!

Why she feels the need to go raking around looking for other cases so many weeks down the line is unclear to me but it still smacks of a desperate attempt to get you to drop the ombudsman escalation, presumably because she doesn't want her conduct opened up to senior scrutiny. Isn't this essentially just more of the same tactic that she's been using for months? Don't fall for it!
  • Have you actually received confirmation from anyone besides the original adjudicator that it has been escalated?

The cynic in me thinks that she's not actually done it yet.

Yes, I think you are right, something brown and runny, trickling down her leg.
