PCP Car - Deal done off premise

Hi,

I purchased a second hand car on PCP 3 days ago. The deal was done over the phone / email, and was delivered to my house.

I've put a 1k deposit down, and no other payments have come out yet. I expect the pcp to start within 30 days.

After reviewing my finances this weekend, it transpires that it was an absolutely stupid purchase. My current pcp expires and i've arranged collection of it, and rushed into this with pressure from the salesman.

Can i return this car? I know there is a 14 day cooling off for the finance, but that just means i have to find another way to pay for it.

I've read that as it was done off premise i may have a legal right to do something. Does anyone have any experience with this?

Quote from thecarexpert

"Buying a car at a distance or off-premises
If you are buying a car over the phone or online, which has become much more common with the growth of online classified sites that allow you to easily buy a car from anywhere within the country, then you do have more legal protection.
The same applies if you are buying a car off-premises. For example, a dealer might bring a car to your house and you sign a vehicle order there, rather than you going to the dealership.
In a nutshell, you have the right to cancel from the moment an order is placed until 14 days after taking delivery of the car. It doesn’t matter if it’s a new or used car, the law is the same."

I appreciate any feedback.

Many thanks,

Matt

    What pressure?

    What pressure?

Sales chap giving me his personal number and pressuring me to pay the deposit same day to secure deal. Tried putting it off until the next day, and then he advised to send payment details via text so i can keep the 'good' rates that they were offering. After about 3 hours worth of texts, i sent him the details.

Do you know if i have an out here or not?

    Thanks.
  • Was the salesman wearing his tie when the deal was done? If not, he wasn’t wearing full uniform so the whole deal is null and void.

Seriously though, if you can get out of the deal, you’ll probably lose your deposit. The time to review your finances was before you signed up to the PCP deal.

I would have just said "an emergency has come up" and ill get back to you and just ignore the texts or block the number

im not sure if they will take the car back but buying the car and the finance are separate, you may be able to cancel the finance but you will have to pay for the car separately unless its not fit for purpose ie: not road worthy

this seems like buyers remorse more than anything, hope it all works out for you
People are caught up in an egotistic artificial rat race to display a false image to society. We want the biggest house, fanciest car, and we don't mind paying the sky high mortgage to put up that show. We sacrifice our biggest assets our health and time, We feel happy when we see people look up to us and see how successful we are”

as the op cited, if you buy a car from distance you can cancel (not just the finance) -you have a lot more rights when buying this way.. seems straight forward enough to me. whether you'll get your deposit back? no idea

Yeah, i tried saying i didn't have the bank card until the evening hoping that he would say thats fine just pay it tomorrow. That's when he gave me his mobile and said to pay when i have it. When on the phone it's sometimes hard to think of a fool proof excuse.

Not at all. I didn't want to get into personal details, but we found out the missus is pregnant (great news) and having just commited to this huge purchase and knowing that we will be down a wage it's get us worried.

I understand that they were two different things. There's no point getting out of the finance if i still have to pay for the car.

i just thought with buying off premise and per the quote provided earlier, that there may be some way out of it.

No worrys, if i was you i would look up as much information as possible i think due to buying on the phone and not seeing the car in person you may more protection

can i ask what was the car and price, is it new and whats the terms the reason i ask is if you are not able to give the car back for some reason then you may cut back on other things in life to balance everything

congratulations on the new baby mate

Did you go to see the car beforehand?

My daughter got a car online with a PCP deal. It came with a 30 day money and car back guarantee which she had to use because of a fault that developed with the engine.

They did exactly what they said they would do and we were so impressed we sorted the replacement car via them.
