Once I get all the facts I will be posting all over this forum, I want to contact Martin Lewis but can't via this website to get clarity once and for all. DRP are saying it is wrong to ignore the charges. What do the courts have to say. There was a case in Dundee where a woman was fined £24k + and they mention this in the letters. The circumstances were completely different. I understand rules and the law and we have to abide by it but I do not like bullies. I want the legal facts and then I can go from there.

Are you taking in what I'm posting?DRP are saying it is wrong to ignore the charges.You would need to have received multiple tickets (probably dozens) and never paid them to make it worthwhile for a case to be put in front of a Sheriff Court.We have never seen a single case in the Scottish courts for a single £100 Parking Charge.Of course they threaten all sorts of hellfire and damnation against you in order to get you to open your pursePlease note, we are not a legal advice forum. I have contacted the manager of Hermiston Gait retail park. The limit is 3.5 hours I was just under 4 hours. The signs are there. I understand that they do not want people breaking parking rules but all they are doing is deterring shoppers. They need to reword their letters. I have phoned DRP who have advised me they are legitimate. We will see.
It would appear your "NOT GETTING IT" (phoning DRP????) you've had replies off some very experienced posters and what they are telling you is 100% correct, whilst you may have technically broken some lame parking rules you have fallen for non substantiated empty threat debt letters and paid it???? your definitely not alone that's how these companies make a living (DISHONESTLY)so don't feel too bad about it.
There is of course the argument as to whether its worth fighting a PCN in the first place as there is A LOT to get involved in, I feel its worth fighting a fake £160 charge or one of the other fake charges they make up but £60, not so sure, course this is only my opinion but for you learn the expensive lesson, good news is I doubt you will get caught out the same way again, a bonus maybe??0 -

Doing that will get your posts removed and possibly banned pretty quickly - and it won't help anyone. Taking it out on us because you made all the most basic mistakes, so got taken for a mug isn't going to help anybody.
Learning from them and applying this knowledge to help others in the same boat will cost them far more in the long-run!0 -
The signs were not very noticeable but they are there. I will not be parking or shopping there again. I have been told that they could take me to court by a qualified lawyer. Is anyone here replying a lawyer? Where can I get free legal advice? Is it worth going to Citizen's advice bureau.
These companies rely on people worrying about this. It affects financial applications for mortgages for example and if someone it taken to court they pay the £160 charge plus court costs. The owner of Hermiston Gait is Aberdeen Asset Management. There is not much I can do to fight a big company and I have paid the fine because the worry of me getting a court letter is worse than paying up. I am still not 100% on if they have done anything illegal. They are registered with companies house, they could take me to court. I have spoken to 4 people who have had these letters, ignored them and nothing happened so the worriers are getting penalised and scared into paying.
I will not get this money back, it is no longer about the money, it is about whether or not they are bullying people into paying up, mentioning court action but not ever actually going through with it. They need to change the wording in the letters or people need to stop parking and shopping at Hermiston Gait.
Every battle is worth fighting, this is why these companies are getting their way.0 -

Why do you now want legal advice?
Debt collectors stock in trade is threatening letters etc
And all "creditors" have 6 years to pursue the "debtor" to court.
Whether or not they win is decided by the judge!0 -

Yes your right they do and it worked on you too! and you paid because of the THREAT of court action, this is where many many people go wrong, they interpret "MAY take court action" to mean "WILL take court action" and the debt collectors letters don't say that, so 100% legal 0% moral, unfortunately courts don't judge them on morals just legal argument.
"They need to change their wording" Yes it would be great and lovely and fluffy if they did BUT they wont, its a big fat cash cow for them.
They wont take you to court now you've paid? but as I have previously said its been an expensive lesson and one you hopefully wont have to learn again.0 -

Is this OP for real? There is a real whiff of bovine excrement with this thread and I think some of us are being wound up like clockwork toys. Whilst there is a certain schadenfreude about some of the posters on here who have shown their naivety and gullibility with regards to PPCs and more so with debt collectors, this OP is still raving on about going after the debt collectors who she has been persuaded to naively pay.
Fiona4444, you do not appear to have bothered to read and digest the Newbies thread which contains all the information you should have heeded before you supposedly paid a debt collection agency yet now go on about being conned as the victim of some horrendous scam. Everything so far has been legitimate. Whilst some of the content of the letters you received may have been distasteful and even distorted, they were legal. If you are so angry that only now you want to get "free" legal advice, why didn't you investigate a bit more before you parted with your hard earned money. You'd be wiser and richer.
