My point is that I want to know the legal facts.

    The legal facts are:

    1) DRP sent you a speculative invoice for an alleged debt.

    2) You paid the invoice.

My concern is that the op appears to have negotiated some sort of settlement. I suspect that in doing so they will have unknowingly dropped themselves in it.

A court win in Scotland is a real feather in a cap for any parking company and this one has the feel of a winnable one for them if they get their act together.

The OP paid DRP and so UKPC are very much second in this.

DRP are not going to risk taking someone to court
due to a chargeback as it would destroy their scam
and Scotland is a small place as we know.

It's up to the OP what they do, he/she could create a
great deal of damage for DRP and UKPC in Scotland

The OP should be made aware that that both DRP and
UKPC are all part of the scammers club membership
    operated by the BPA

Car parking company UKPC. Who are their regulatory body?
They don't have one, that's the main issue. That's why Parliament are finally waking up and doing something about it - hopefully, but I do start to worry that the Brexit mess we are in might push it on a back burner somewhere.

  • I have contacted the manager of Hermiston Gait retail park. The limit is 3.5 hours I was just under 4 hours. The signs are there. I understand that they do not want people breaking parking rules but all they are doing is deterring shoppers. They need to reword their letters. I have phoned DRP who have advised me they are legitimate. We will see.

    Phew!

So guys, it looks like we were all wrong.

    DRP are legitimate - it's official. ;)
  • Once I get all the facts I will be posting all over this forum, I want to contact Martin Lewis but can't via this website to get clarity once and for all. DRP are saying it is wrong to ignore the charges. What do the courts have to say. There was a case in Dundee where a woman was fined £24k + and they mention this in the letters. The circumstances were completely different. I understand rules and the law and we have to abide by it but I do not like bullies. I want the legal facts and then I can go from there.
  • if they are not legitimate they should not be registered with companies house or trading.

With respect Keith, DRP do not send speculative invoices,
they only send threatening letters with misrepresentation

You are now fighting a battle you can't win!

Put it down to a learning experience rather than waste time and effort.

In future take more notice when you park of the contract you agree to when parking!

And read up on debt collectors in #4 of the newbies faq thread near the top of the forum so you know what to do if this happens again

Martin won't be interested now he's sold MSE and is now a TV celebrity (how soon before 'Get Me Out of Here' offers are gratefully received!). He won't clarify anything, in fact, the official MSE advice (not that of this sub-forum) provides anything but clarity. Actually their official advice puts the registered keeper in harms way, which will cost them money, not save them!
