CCJ Old Parking Fine

Hi Everyone

I am after some advise if possible. I have today noticed a dramatic decrease in my credit score, upon investigation. I have found a CCJ dated April 2018 but with my old address on. I moved into my new home July 2016. I have contacted the court (Northampton) and they have told me the parking offence is from April 2016. I assume any court orders have been sent to my old address. I changed address with the Dvla as soon as I moved homes.

Is it worth me going through and paying the £255 set a side fee ? I have no issues with paying a parking fine if it is valid but surely they can’t issue a CCJ without my knowledge?

Any advise would be great fully appreciated.

    Have you read the thread at the top of this board that tells Newbies to read it first? Post 2 in that thread covers the court process. You are now beyond the time to pay the ccj in order to have it removed. If you want the ccj removed then you will need to obtain a set aside.
  • Depends how much you value your credit file and how much you rely on it being in good order!


    It's a sneaky underhanded way of obtaining a CCJ against you but perfectly legal (mores the pity) and yes they can do this IF your not on the ball with all your paperwork, especially addresses.


    All is not lost though you can apply for set aside and then fight the PCN with good help from here but be aware if that's the route you choose your in for the long haul, I am 6 months in and still battling away like the Welsh guard at Rourke's drift!!!
  • Thanks for the reply’s I have just read the other thread and it makes a good read. I am in the exact same position of the lady that had hers set a side so going to go down that route with it.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the House of Commons recently

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.
    You never know how far you can go until you go too far.

    If you have used your real name as your forum username you would be well advised to get it changed to something much more anonymous.

    To do that, read this short extract from The MSE Forum Guide - Frequently Asked Questions & Rules:
    Q. How can I change my username?

    A.
    In most circumstances, this is not permitted.

    The only reason we will change your username is if it puts your privacy at risk. This usually means you've inadvertently registered using your name, email address or something that gives away your identity within your username.

    If you fall into this category, email forumteam@moneysavingexpert.com and request that it is changed, giving three alternative usernames in order of preference.

    As I said it can feel like a long drawn out battle but definitely worth it in the end, sometimes it's much more than the aggro and money, its the PRINCIPLE!!

    Just as an aside when you say you changed your address with the DVLA do you mean you sent off both your licence and your V5c to the separate departments?

    It's amazing how many people just send their licence and think that updates the V5c too.
