    Ok, thats done.

The background is that the overstay was genuinely unintentional. Normally the car would have moved between a couple of locations for the weekly shop, but this time the town centre was closed due to the Tour of Britain cycle race, so the shop had to be done on foot. It's a free car park with ANPR.
The Aldi the car park is for was also visited, they have quite a lot of signs up in the car park:

Wipe those links, they add nothing BUT the hosting site you are using does reveal your name and and your mugshot!

Standard PE signs (for those curious following deletion of links).
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • So here's something I didn't expect, I wrote a fairly pleasant letter to Aldi customer services, and after their first response asking for more details, I've got this reply:

    Dear Mr A......

Thank you for your recent email regarding the parking charge notice that you received.

On the basis of the evidence provided, I am happy to contact ParkingEye and get this charge cancelled.

As you are now aware, ParkingEye manages this car park using Automatic Number Plate Recognition (ANPR) cameras that monitor cars entering and leaving the car park. This system is in place to ensure free parking for our customers.

I hope that this satisfactorily resolves this matter for you. We value your custom and hope that you will continue to shop with us.

    Yours sincerely

Well done! Not unexpected though - complaining to a retailer like Aldi as well as appealing (and exhausting the retailer complaint option before even trying POPLA) is the suggested route in the NEWBIES thread.

I will add your success to the list in the link here, taken from the sticky thread:
ALL CASES - COMPLAIN FIRST, ESPECIALLY OVER A RETAIL, HOTEL, OR HOSPITAL CAR PARK:

Always complain to the Retailer very quickly and assertively, WITH A RECEIPT IF POSSIBLE:

Successful complaints about private parking tickets - how to get them cancelled! <<< CLICK

See how easy it can be to get these cancelled by a retailer/hotel/landowner. VERY EFFECTIVE AND DAMAGES THE PPC!

    Another Aldi one cancelled! :T
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:

  • They are !!!!!!!s! Best of luck, I’m still fighting them for parking in a car park whilst lost and using a sat nav without getting out my car!
    Currently with county court!
