    Hi,

I want to write an affordability complaint but my debt was sold to Cabot but it was originally from MBNA.

Do I need to address my complaint to Cabot or MBNA?

    Thanks…tksnota
The original debt was with MBNA.

So any complaint goes to MBNA obviously.

Nothing whatsoever to do with Cabot.

    Hey all.

Just managed to escape being tied to a family mortgage which left my finances a mess in 2016 and I wasn't even able to live there.  I have managed to get equity from with which I can clear my DMP . I was dealing with step change who were life savers at the time. I haven't spoken to them yet, but what's the best approach to keep as much of the equity as possible, not !!!!!! lenders and finally end the DMP. I'm happy to off a 100% of it, but would be delighted if I can get it down to 70%.  Would it be best to call each debt, ask for full final settlement? Or ask step change to negotiate?
Are you still in a DMP and paying monies to the original creditor or whoever owns the debt?  Whilst SC are great at what they do, they will not be in a position to offer you the best f&fs.  It's not an exact science, so your negotiation tactics very much depend on where you are in the process in terms of how old the debts are, who owns them, whether you have gone down the route of getting them to prove the debts are enforceable etc. etc.
  • Just received a letter from cabot saying “we havent heard from you so may need to ask our solicitors to take legal action. This could result in a court judgement against you.”

Should i consider this a letter before action?

Why are you ignoring Cabot, any good reason, they may do as they say?

Good afternoon all. I have received my 1st email today after starting my dmp. Moorcroft have emailed to say they are working on behalf of fluid. Can I assume my credit file has been defaulted as its not showing on there.
    Cheers

No good reason anymore. I had submitted a CCA request which they responded to so I think I’m at the point of setting up a payment plan with them. I had been trying to delay to build up my savings pot.

No, never assume anything, unless you have had a default notice issued under sec 87(1) CCA giving you 14 days to clear the arrears on your account, then no, you won`t have been defaulted.

Moorcroft may just be chasing your arrears and nothing more.

Cheers for your reply. I can see my account has been terminated. But still no default. Moorcroft are ringing a few times a day. Do ignore and wait for the default or speak to moorcroft?
    Cheers

A default notice issued under sec 87(1) CCA has a 14 day response window, after which a default can be registered, check again in a months time.
