daffodil5 said:Slightly panicking (well quite a bit) as I have today received a letter of claim from PRA re Barclaycard debt of £10k, since last February I haven't paid or contacted any creditors following advice on here, and gave been ignoring letters and calls from them all.
I assume I have to fill in the form they've sent, to avoid further action, and can if I need to set up a monthly payment by standing order to them within what I am able to afford, they have emailed me with details of how to set this up online.
I am just worried that they won't accept the amount I'm able to offer (paying £40 a month or should I offer less?) and will still take me to court. Has anyone else had a payment offer refused?
This is the only debt which has sent a letter of claim, all the others are still sending the usual letters so I'm hoping to deal with them as and when they ramp up the pressure.
The total I can afford towards all my debts is £150 a month, the Barclaycard is the largest debt I owe. I have built up some savings as per advice on here since last February.
I did speak to Payplan early last year but decided to not start a DMP until my debts default after reading the advice on here so haven't been in touch with them since.
I don't know what to do with regard to setting up a DMP as I'm not sure I want to go self managed or if I would cope with that, my mental health is not great at the moment and I'm leaning towards going back to Payplan, or is it easy to set up my own DMP, but do the debt collectors leave you alone more if you're going through a debt charity? Very torn and a bit overwhelmed right now.
Thanks for any advice x
Respond to the LBA with an offer of payment, also tick the box for evidence of liability.

So they will just accept my offer of repayment and I don't need to prove to them that's all I can afford?1 -
We went self managed on our DMP a few years ago and have been paying them off slowly at minimum amounts. All are now sold on to other debt managing companies and all are being brilliant with one exception. We have cleared a few already when they have sent F&F offers that we could afford, and as we have now managed to pay off our mortgage early, we are now in a position to make more offers and get them all cleared. The only company not playing ball is L*nk. Has anyone had any experience of getting good offers from them. most other companies seem happy to settle at 20-30%, but L*nk have so far only agreed to knock £200 off of a £2400 debt. Just wondering what others experiences areMaking the debt go down and savings go up

Has anyone had any experience with Mycommunityfinance loans on a DMP?0

Basically, My Community tend to be tougher to deal with, so it's wise to engage sooner rather than later. If they are threatening legal action, offer a monthly payment. If you've have not made a mistake, you've made nothing0

payment at the amount I specified, all I have to do is make the payment (intending to set up a monthly standing order for this) so I had no need to panic at all. Lesson hopefully learned and thanks to sourcrates for the advice.

I sent a CCA request to PRA for a Barclays debt and they initially replied that it was temporarily unenforceable. I've just received a new letter saying they enclose copy documents as requested. They have provided 2 months worth of copy statements but they haven't provided a copy of my credit agreement with all Ts and Cs, which is what national debtline outline should be provided:
https://nationaldebtline.org/get-information/guides/credit-agreements-getting-information-ew/#:~:text=to say no.-,Consumer Credit Act request under sections 77, 78 and 79,account signed by your creditor.
PRA have asked me to get in touch within 14 days. Should I be writing to them to challenge that what they've provided doesn't meet the request under the CCA?Tilly Tidy 2024 = £88.99 / £2001 -
Yes of course, just don`t expect them to respond, they will most likely just send another demand for payment.

With that said, I think I'm right in my understanding that these debts are quite old and the defaults have left your credit records. So, have you ever sent a CCA request to check if these are actually enforceable? If so, fair enough and you might just have to keep paying them the minimum - but don't keep offering F&Fs on a regular basis. I've read in the past that some creditors are keener to close debts with decent discounts towards the end of a financial year.
If you haven't gone down the CCA route - then do so, it might nudge them towards an F&F that suits you or at least in the meantime the debt becomes unenforceable.
What you don't want to do is indicate to them that you are overly keen to clear your debt because you are not giving them any incentive and the ball is therefore in their court. At the end of the day if the debt has dropped off your file and the amounts you pay are minimal, I'd just treat it as a bill and just trickle feed it for however long it take. Maybe just offer an F&F once every now and then.1 -
Thanks @Suseka97. Yes we have checked a few years ago and they are enforceable.....sadly.
Interesting that they may accept offers towards end of financial year, that's maybe worth a try with one of them again later.
Its just unfortunate that we have a big chunk with them. The other conpanies are much more accomodatingMaking the debt go down and savings go up
