    @lisamarie85.
    You need them to agree to the following wording:

    "I will accept this offer on the clear understanding that, if I pay it, neither you nor any associate company will take any other action to collect or enforce this debt in any way and that will be released from any and all liability".

    Get them to agree to that wording, and all is good, your credit file will be marked as a "partial settlement" but remember the whole entry will vanish on the 6th anniversary regardless of what happens.

    like sourcrates wrote if you can get them to send you that paragraph in writing you are 100% sure then.

    I know when I got my offer from them , I asked  in email are you 100% sure that my balance will drop to zero and debt is fully finished, yes was the answer.

    I think the letter you got back is simply how they word it to all their clients explaining the account will be closed and all outstanding amounts will be marked as paid

    if you want 100% peace of mind ask them to write that phrase that sourcrates stated in a letter or email within next 14 days to you. never by phone call

    I know they say this is a one time offer, but they will offer again, perhaps even lower
    if you wait it out.

    I asked will my offer be valid again in future,they said can't guarantee if it will be lower or higher they said
    Christians Against Poverty solved my debt problem, when all other debt charities failed. Give them a call !! ( You don't have to be a Christian ! )

    They hold all three of my accounts and last year they offered a discount to settle on my Halifax account. I owed £4735.89 they offered £3315.22 and I countered and got them to £3079.00

    I thought at the time, it’s their first offer, I’ll ignore it and see where we end up. It’s now over 12 months on and the lowest they’ll now take on that account is £3602.00. Go figure! So that’s why I’m tempted to take the Tesco offer as I know the Halifax one has defo gone up since their last offer.

    Thanks for all of your help everyone
  • I sent them sourcrates wording and they wouldn’t send that.

    All they will agree to is;
    We will send you the following statement that advised that your account has been closed. "Paying this amount will be accepted as a full and final settlement on the account, which means your account will be closed and we will not contact you about it again about."

    Is that enough? Even though the last “about” doesn’t make sense to me.
  • The actual email received;

    What you owe us: £4,659.81

    Who you owed and their reference: Tesco Bank/ **********

    Hi Lisa Marie

    Thanks for your recent contact.

    We are pleased to confirm that your settlement arrangement of £2,918.00 has been set up for the the 16th of August 2024 .

    If you are having difficulty making a planned payment, please contact us as soon as possible. We cannot guarantee that a settlement offer will be extended if your payment is missed. If you do miss a payment, we will contact you to understand what has changed and discuss how we can help you.

    If you are looking to pay this by bank transfer, please use the below details:

    Bank Transfer / Cash Payment **Remember to quote your reference from the top of this email**
    Royal Bank of Scotland
    Sort Code: 16 00 02 & Account Number: 21117336

    Paying this amount will be accepted as a full and final settlement on the account, which means your account will be closed and we will not contact you again about it.

    If your account is still reporting on your credit file please be aware that a settlement will not reflect as positively as paying the full balance. This will show as ‘Default Partially Satisfied’ when you make a final settlement payment, instead of ‘Default Satisfied’ if you paid the account balance in full and this will remain on your credit file for six years from the original default date.

    It only states "we will not contact you about it again" .

    It doesn't say we won`t sell the remaining balance to some bottom feeding debt buyer and they will continue to hassle you for the money.

    Personally that`s not good enough for me, the standard National debtline letter uses the terminology that they won`t agree too, which automatically makes me suspect them of being less than honest.

    I would tell them to do one, have you done a CCA request on this debt yet or at all???

    Feel like I’m going round in circles with them!! Latest reply after I told them it wasn’t good
    eniugh is;

    To confirm, the wording has been amended to "Paying this amount will be accepted as a full and final settlement on the account, which means your account will be closed and you will not be contacted again about it. As your account is still reporting on your credit file please be aware that a settlement will not reflect as positively as paying the full balance. This will show as _Default Partially SatisfiedΦ when you make a final settlement payment, instead of _Default SatisfiedΦ if you paid the account balance in full and this will remain on your credit file for six years from the original default date."

    I’m still not sure that’s good enough either? What a pain they are

    like I said when they offered me a discount that was the wording they wrote to me, and when I wrote is that a definite that it will never be sold on , all i got was a reply saying yes that's correct

    you could email with the same question I asked will the remainder be sold on or have you wrote it off

    if they reply saying yes, that's correct ,it will be wrote off, then you save the email and pay the settlement figure

    on a side note, I don't think I've ever come across a post on mse where pra have ever sold the  remaining debt on after a full and final settlement price has been offered and accepted
