RebeccaO26 said:Hi all,
Hope you can help me - have been in touch with stepchange in order to set up a DMP. Contacted all my creditors last week including creation who agreed to put a 30 day hold on my account and advised me to cancel my direct debit which I did. However, this morning they've now issued me with a notice saying they're going to add a charge of £30 to my account if I do not reinstate the direct debit by time they generate my next statement.
I am considerably less stressed out than I was last week (I am now of the opinion that they cannot take what I simply do not have) but I wondered if anyone else had experienced this and if so what did you do? I don't know if this is a monthly charge or a one off to try and scare me into paying?
If its monthly and they charge me till they default me then (assuming it takes them 6 months to default the account) I could have an additional £180 added to my account plus any late fees they see fit to charge. Obviously I'm keen to avoid this so any advice is much appreciated!
I have never heard of such a fee to be honest, just for paying via a different method.
Makes no odds what they charge you, you can always choose not to pay it, you also have the right to complain to them, and that is what you should do, in writing, make an official written complaint (get used to writing these, you will be writing a few) this type of charge is whats known as a penalty charge, and cannot usually be enforced, as they are normally dis-proportionate to the actual breech you, allegedly committed.
Are you 100% positive that is what the letter says, as they offer various payment methods, why would they make a charge for canceling a DD ???I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. The rules in FCA handbook say the following about the suspension of an account for 30 days:
CONC 7.3.11A firm must suspend the active pursuit of recovery of a debt from a customer for a reasonable period where the customer informs the firm that a debt counsellor or another person acting on the customer's behalf or the customer is developing a repayment plan.
Edit: I forgot to say that if it were me, that on the basis of the above rules, I would be making a written complaint to Creation.CONC 7.3.12A “reasonable period” in CONC 7.3.11 R should generally be for thirty days where there is evidence of a genuine intention to develop a plan and the firm should consider extending the period for a further thirty days where there is reasonable evidence demonstrating progress to agreeing a plan.
I work within the voluntary sector, supporting vulnerable people to rebuild their lives.

I've heard and seen loads of people on here say push for defaults but I'm not sure my nerve can hold for the next 6 months if I don't pay anything and they're chasing me for payments!0 -

Good morning, a quick question if I may,
awaiting all accounts to default and saving an ef, got my first letter from a debt collector today, now I wrote to all creditors stating what was happening, so I let the debt collector know that I will be setting up a dmp in the next few months? Or do I ring them and offer a token payment? Worried if I’m radio silent they might send people round? It’s moorcroft. Thanks for your time0 -

Moorcroft just mange debts on behalf of their clients, and are a usual first call option for many creditors, they operate out of a call center in stockport, the staff wear comfortable shoes, not hob nail boots.
There involvement in your case only goes as far as the sending of there standard range of collection template letters, gradually increasing the threat level, over the next few months, after which your account will be returned to their client as uncollected.
They will not be interested in your DMP arrangements, nor will they be interested in your offer of token payments, they only get paid on results, no money, no result, you can ignore this one for now.
As the creditor has passed your account to collections so soon, it seems likely that they may sell it on before long.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Need help if possible. Just switched from Stepchange to self managed. So far so good apart from a company called CRS (credit resource solutions) they are collecting on behalf of two of my creditors but insisting i pay via their website OR CPA. I dont want to up CPA I want to set up a standing order but cannot get their bank details. Any ideas, they just being damn annoying. The problem is I want them I want to pay I dont want this to get behind because I am working to be debt free this year. They are certainly NOT making things easy, swapping changing references, then saying I have not paid because when I have just under the old reference because they changed it AGAIN..............this is a regular monthly issue with them. Nightmare company!

They are only acting on behalf of their clients, so you can ignore them if you wish, save the money up you would have paid, eventually they will return the account to the OC, and another DCA will be appointed.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
