    Hi all after some advice or process to complain about a creditor:
    So I set up my own dmp early last year with most accounts set up with plan and defaulted (approx June last year). I have 3 accounts with creation one of which is defaulted and being dealt with by solicitors threatening legal action. 
    If it were me, I would be withholding payment on the two Creation accounts that have not defaulted, as that should hopefully prompt them to default the two accounts.  When an account is defaulted, interest becomes frozen.

    I also recommend you only correspond with Creation via Royal Mail letter.

    If you are sticking to your scheduled DMP payments toward the defaulted account, then the solicitors that are 'threatening legal action' would probably be auto-generated letters, as it would be unlikely they would be going down the enforcement path when you are adhering to your scheduled monthly payment plan.  :)

    So I don’t make a payment in the 2 accounts that aren’t defaulted (I’d read that advice before so had withheld) so they have continued to chase and charge for around a year.

    The so called solicitor is a apart of the same company, they probably share an office, and the same address, they are nothing special, and you treat them in the same way you would a debt collector.

    They work through a series of standard template letters that are designed to get you to contact them, its all rather cheap and tacky really, some of the letters are quite laughable, one i received once had the word "debt" mis-spelt as "dept" an error i quickly informed them of, and, as suspected, never heard from them again.

    You cannot make an individual complaint to the FCA, the FOS is the complaints handling organisation, set up by Government for that purpose.

    However you must exhaust the creditors own complaints process first, every creditor has one, instructions on how to complain will be on their website, although best practice is to do it in writing, they have 8 weeks to provide you with a response, as with everything, you must use the correct complaints procedure.

    Thanks Sourcrates. I believe it is a legit solicitors I’ve checked they are called shoosmiths and I’ve seen someone else refer to them on here. 
    Ive complained to creation before but got bombarded with more requests for documentation including payslips and I me Ervin know how to respond to this when I don’t want to provide them?

    Hi I am having a bit of an urgent dilemma - going into April I have £150 to feed 3 'adults' through April. My DMP is £125 and the money goes out tomorrow - but I am thinking about cancelling it and calling Step ch tomorrow and just put it on hold for a month or two. I was have will have lost 3 days of work, that would have made it possible to pull through, but now I dont know. I could probably make it but I would be emptying my EF at the end of it, and I don't like being stuck, unable to work and not have any EF at all. Maybe I am just being spoilt and I should think it is lots of money but we usually spend between £50 - 70per week for two! This is for pretty much everything food, we dont go out - and now we definitely dont. Sorry for thinking out loud. BUt I kind of just want to keep going, I also don't want 4 weeks of endless conflict over food!

  • Cancel the payment now. Even better, move the money out of the account so you 100% know it won’t be taken. Food is MUCH more of a priority than debts, even more so in this climate. 
  • I need advice! I set up some £1 token payment offers with the creditors that I THOUGHT had defaulted me already. However it looks like they haven’t. Despite sending me the default notices they’ve not marked my credit files as defaulted. I’d rather wait until I see it there with a default date before I start repaying anything otherwise I risk the dreaded AR markers instead. 

    Question : these payments are all due to be paid on 1st (tomorrow). Should I just not pay and ignore them so they default me , or tell them?

    what I am cautious about is if I break the arrangement now they might not be willing to avoid court action in the future

    Its no dilemma, unsecured debt repayments are non priority debts.

    Eating, and keeping a roof over your head is a top priority, don`t prioritize debt over food, ever, what do you think will happen ?

    Answer, nothing will happen that`s what.

    It make`s me so mad that people even contemplate going without food  in order to pay their credit debts, no one cares if is paid or not, the debt will just be endlessly chased for years by anonymous debt collectors, sending stupid letters.

    Have been paying g £1100 for 2years,still 2 to go. Now I fear my job could be in danger and I want to take a 2month payment holiday just to see were I am. I have been in touch with step change(😁) but not clear if I should just cancel my DD or ?? . Any thoughts welcome.

    I agree with others that you should cancel, but I think you may have left that decision a little late - so I hope you've tried to do that already.  If the money does go out then get in touch with SC and explain the situation and ask them to return the payment.  Your payment plan really needs to be a sustainable one and at the moment I doesn't seem as if it is, so better to put on hold until things settle down.

    That depends on what SC said when you contacted them. If they agreed, then they shouldn't take the DD payment when its next due.

    Yep I missed it - when I finally checked it had gone out. I will write step change today and see what they can do, and probably see if I can pause it for 3 months. Thanks for 'common sense support'.
