Do I need to go back to my original appeal?

I didn't respond or get any photographic evidence from them. I also didn't receive a rejection letter or even a referral to IAS to get the popla code, as pointed out in my complaint letter to BPA.

Why do people always want a ''next step''? You've complained to the BPA; that was the step.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • BPA have investigated and finally got back to me today and said CUP/PCS had sent my an appeal letter that I haven't received. I am still waiting for the attachment from BPA of this phantom appeal letter.

Has anyone experienced this before? I assume my POPLA code should be on this letter. Will I still be able to appeal to IAS?

No, it will be out of time and you will then ignore them. Yes we've seen this before.

  • That's rather convenient for these scumbags. So i don't get a chance to appeal to IAS or even see any evidence they may have. Complete farce. Surely BPA will be noticing this trend and should act upon this.

I'll ignore any further letters unless from the courts.

Thanks for the help so far.

The BPA won't do anything as they are on the PPCs' side. The PPCs are their paymasters.

If you get it attached to an email, make sure you check the 'date document was created' in the metadata of the alleged rejection letter...

I just received the letter and checked the meta data but that suggests it was created back in September, when they claimed to have sent it to me.

I know it's timed out but is it worth still trying to appeal with my POPLA code to IAS due to this delay?

Just been on the POPLA site's FAQ and saw this
Can I submit an appeal late?

In exceptional circumstances, the assessor may be able to extend the 28 day time limit. If you are submitting your appeal late you must state fully and clearly the reasons for the delay. You must also provide any evidence you have to justify the delay, along with your appeal. The assessor will then decide whether the appeal can still be considered.

I think I'm going to appeal as this is the first time I have seen the POPLA code and rejection letter.
I'll look at the templates in the POPLA sticky thread but are these appeal points still valid and winnable?
    1. Grace Period: BPA Code of Practice–non-compliance
    2. The entrance signs are inadequately positioned
    3. No Evidence of Landowner Authority - the operator is put to strict proof of full compliance with the BPA Code of Practice.
    4. No Evidence of Period Parked - NtK does not meet PoFA 2012 requirements

may as well try it seeing as you have a valid reason for the delay

all the appeal points in post #3 of that NEWBIES FAQ sticky thread are valid, that thread is kept up to date, so no need to ask
