PCN Appeal Help

Hi,

I received a PCN via a letter dated 10 Aug 2018 which I believe is the Notice to the keeper from CUP Enforcement, via Parking Collection Services aka Dept Recovery Plus Ltd. I did not get a windscreen PCN on my car. After finding this forum and following the Newbies FAQ, I submitted my appeal to parkingcsl.co.uk/appeals using the template in the FAQ without admitting any liability or giving away who the driver was. My appeal was submitted 19 Aug 2018 and I hadn’t received any response until today 17 Sep 2018, with a letter dated 28 Aug 2018. The letter doesn’t mention the appeal was rejected but rather asks me to provide more details to support the appeal so that the circumstances can be fully considered. It also invites me to still pay for the fine. I’ve attached both letters with personal details removed.

I had already asked for the photographic evidence in my appeal but they have not sent me anything and instead have asked me for more details.

They have not issued me a POPLA code at this stage. Any advice on how to progress with this will be much appreciated.

    IGNORE the phishing response and wait for it to time out and then they "should" send you a popla code
  • Thanks Redx. How long is the timeout period? Is that from their recent letter or from my date of appeal?

    BPA rule - 35 days from +/- the date of receipt of your appeal.

    assume its 6 years but reading the BPA CoP (which you have done so ?) its 35 days as mentioned by Umkomaas above, but could be longer and isnt enforced

    if you get a debt collector letter in the meantime (from DRPL or ZENITH or PCS) , THEN COMPLAIN to the BPA AOS by email with copies of ALL paperwork so far , with a brief timeline - ditto if they add fees on trying to make it £120

    the main thing for now is not to speculate, but await their next move , then respond to it appropriately

    and read that BPA CoP whist waiting, dont get caught out due to poor research

    I still haven't received my POPLA code for my appeal but have now received a letter from Debt Recovery Plus Ltd, with a parking charge of £160 now. It's been over 35days and over 2m months now.


    Shall I respond back to them or the original PCS, or just complain to BPA?

    CUP - small fry operator. Get Steve Clark of the BPA to whip them into line.

    I've submitted my complaint to BPA now and waiting for a response.
    I'll ignore the DRP letter as well. What will be the next steps for me now?

    It very much depends on the BPA's response.
