Not even close. If you are backing out of your driveway, across the pavement and onto the road, then it is totally and utterly 100% your responsibility to ensure that there is nobody coming on either. If you hit somebody on the pavement that you are crossing it is totally your fault.

It isn't illegal to reverse out of a drive, but I wouldn't do it, as it makes you pretty much a slam dunk at fault in an accident as the Highway Code (and any decent driving instructor) advises against it.
Oh and Andy, I don't think there is mileage in criminal damage since the OP was hitting the car to warn the driver that she had hit her. Sounds like a perfectly good defence to me.0 -

But all joking aside, people reversing out of drives is another of those things you see regularly. Why it's easier to reverse out onto a road than to reverse in I don't know, but they do it.
Personally I'm also very careful of walking behind cars that are "nose in" in a parking space or drive. The driver may well have disengaged their brain before engaging reverse, and anything smaller than a car in the way, like me, could get squished.0 -
I was taught that it was illegal to reverse from a minor position into a major position (ie from a minor road/private drive into a major road/public footpath or road. Only with help have I ever reversed from my drive onto the road.

Either you were taught incorrectly, or your recollection has faded with time.
The Highway Code (201) tells you: "Do not reverse from a side road into a main road. When using a driveway, reverse in and drive out if you can."
That does not make it illegal in itself. However, it could be used as evidence of careless or dangerous driving.0
