car reversed from driveway

Hello
I was travelling past a neighbours driveway on my mobility scooter , when the driver reversed into my side she caused my scooter to tilt towards the road i banged on the back of her car but she kept coming so i bashed the car with my fist she realised what had happened then pulled forward , i moved past her house and stopped , she came over to me and apologised saying the sun was in her eyes.. i am really shaken and my hand hurt like heck. she said she would get her husband to come over later to check as to if i am alright.. my husband went to see her husband to inform him we are having the scooter checked out by a mobility healthcare engineer , and if there is any costs then we want to go though her insurance , her husband said that i said it was 50 50.. no way.. there were no witnesses but any idea where i stand please.. her husband said he will claim off our insurance for any damage to her car. i feel sick and fed up .. can anyone advised please thank you.. sky..

    Even without witnesses, she is going to have trouble explaining how it is in any way your fault that she reversed over you when you were on the road/pavement.


    You need to report it to the Police, as you were injured (The Law says she must) and then with her registration number you can get her insurance details from the MID and claim directly from her insurer.



    Happens to me all the time when walking the dog.
    I see them come out of their house and get in the car as we are meandering up the street, but they can't be bothered to even notice us.
    We steadily walk up the street on the pavement whilst they start their car and just sit there with the engine quietly ticking over, and sit there, and sit there.

    Then at the exact instant that we are crossing their drive, they ram it into reverse and shoot backwards at high speed, as I haul the dog back out of their way.
    They usually stop in the middle of the road, whilst horns blare and they start arguing that it is their right to just back straight off their drive without warning, and the cars are speeding as they appeared from nowhere.


    They don't even notice that they would have run us over if I was partially sighted or didn't have the reactions of a cat.


    Thoughtless? Careless? Ignorant? Arrogant? I know what I think...
    I want to go back to The Olden Days, when every single thing that I can think of was better.....

    (except air quality and Medical Science ;))

    I doubt you will get any money for your injuries to your hand after punching her car, but go for damage to the scooter.

    You have posted this in a previous thread, would you like to point out which rule in the highway code states that it is 'illegal'.

    Oh the irony. Can you point out where in the Road Traffic Act it says the Highway Code is the law? The Highway Code is a book advising best practice with some references to the law (HC riles which say "MUST" in them). Always has been, always will be.
