I added a little paragraph at the end about hardship if time off work would be required to defend this frivolous case at a hearing with a view of claiming costs later down the line. Didn't have time to get advice on that so let's hope it doesn't bring all of my defence...

    Hope you signed and dated it, and emailed it as an attachment, to the CCBCAQ email addy, with 'URGENT DEFENCE - CLAIM NO XXXXXXX' in the subject line?

    As you seem to have gone so close to the deadline(?), I would ring the CCBC and ask them to mark the case as defended and make sure they fish your email out tomorrow, in case the Claimant swoops to get a CCJ by default.

    I did all that yesterday and logged in before 4pm to make sure that it was updated on the MCOL website and it said my defence was received.

  • That para makes no odds - youre expected to claim costs for loss of leave or pay, up to £95 for a half day (total, never more than a half day is allowed)

    A new development!!!

    I wrote to the CEO of the trust a few weeks ago to ge them to pull the case since it was their fault I had to stay in hospital, and they have written me now making an offer to pay a part of the charges plus legal fees on the condition that I settle the rest with UKPC directly.

    I wrote back to say that they should make this payment to me and I would settle via legal means as the case was already in motion.

    They wrote back to me today very pushy saying that their offer was only for a limited time otherwise the case would proceed in court. They told me once I settled with UKPC by X date they would honour the offer and pay the rest.

    I wrote back again saying that as a public body paid for by our taxes they shouldn't look into favouring a private company and as an impartial party it would make no difference to them if they paid this to me or UKPC unless of course they had vested interest in the sums collected by UKPC and they woudn't be making a payment to them at all... :rotfl:

    Let's see what they say!

    I've sent my DQ to the court and UKPC today. I have also received theirs from SCS law. Do I take it they want to proceed to court since they have completed the DQ? Do I need to be doing anything in the meanwhile?

    If your DQ has gone then you wait until the Notice of Allocation / Hearing date which will come in a couple of months time.

    Use the time to collect evidence through Subject Access Requests.
