MOT expired, what happens if it fails the test?

    It is just you are recorded on the database now and so the police can check.


    Of course the garage can also ring the police to stop you, but they could before.

    Oh I get it, they're still powerless to stop you driving home and you don't commit any offence in relation to using a vehicle without an MOT.

    Indeed, but they could call the police. And of course you would aslso have to call them if they refuse to let you drive away.


    And as you are well aware but being obstinate about you are commiting and office and would have been previously.


    Will anything change however. I doubt it given the lack of funding for the police. Even if called I would expect them to say they have noone avaiable to attend.

    Thing is they can't refuse, never could and still can't.

    So do you have anything else to say in relation to an mot offence and driving a failed vehicle home?

    of course if you put your car in before the MOT is up, then you can drive your failed car home or to a garage to get it repaired because the previous MOT is still valid.

    Firstly, in my case it would’ve gone in early, I wrote down the wrong date which was an error, secondly, I’m not sure the old MOT is still valid if it fails anymore, the fail is recorded on the national data base, also you would knowingly be driving an unroadworthy vehicle.
    I hate football and do wish people wouldn't keep talking about it like it's the most important thing in the world

    I don't believe the law has changed, but now we discuss the endless possibilities online for days/weeks/months :)

    The old MOT is still valid, and the car is not necessarily unroadworthy.

    Driving a vehicle on a public highway in an unroadworthy condition is an offence for which you can be prosecuted.With or without a current MOT.
    Driving to a testing station with an appointment with an expired mot is not an offence. However if you were stopped and the car found to be in an unroadworthy condition you can still be prosecuted.
    It is the drivers responsibility to ensure the vehicle is in a roadworthy condition - not a MOT tester that last saw the car 11 months ago.
    An MOT says a vehicle road worthy ONLY AT THE TIME IT IS TESTED.

    Yes, it is. It's valid until the expiry date.

    As it has been for the last dozen years. Nothing has changed.

    You may be, you may not be. Let's say it failed on a non-functional 13pin towing socket (and you weren't towing). Or it failed on a rear seatbelt (and there was no rear occupant). Or it failed on a number plate light (in daylight). Or wiper blades (in dry weather). Or it failed on a tyre (which you'd already changed but not re-tested).


    Of course, it well may be unroadworthy - in which case, it was unroadworthy on the way to the test station, and probably yesterday and last week when you were driving around blithely thinking you had ages to go on your MOT...
