MOT expired, what happens if it fails the test?

    And that'd be down to unroadworthiness, which was the same on the way to the test...

    So the only difference is that you know it's illegal to drive, rather than merely driving illegally in blithe ignorance...

    Has the law changed? You could always drive home from a failed test.

    No if there was a major fault you never could.


    Of course there was no recording of it so no-one would know.


    If you were stopped and the car checked you would still have been fined.


    All that has happened is that is is easier to check.

    Yes, in the same way that you can still drive a car whilst being out of your head on alcohol or drugs. Physically you can do it but it's illegal to do.

    If your car fails the MOT on something that makes it unroadworthy then you can drive it on the road but you would be acting illegally in doing so.

    What part of nothing has changed are you not getting?


    It is just you are recorded on the database now and so the police can check.


    Of course the garage can also ring the police to stop you, but they could before.
