    I smell a rat.
  • I would imagine your friend and his girlfried will have to prove where there were with witnesses and maybe debit/credit card receipts etc - that might help them but to honest I expect the Police hear the line everyday of "But it was me officer - honest!"

They are bound to be sceptical about it as the story does sound very bizarre.

Cloneing is the best story, sorry explanation ... or would have been if it hadn't have been intermingled with the story, sorry did it again, explanation that the keys were left in the door. If we believe the keys were left in the door then the chances of the 'cloned' number plate being used for an offence on the very same night that the keys were out of the owners possesion is a story, damn it, explanation that puts the chances of this being true .... beyond reasonable doubt.

What offence was it for, as you havent said.
IF your mate is telling the truth then fine, but if not just tell him to hold his hands up and take the consequences.
The police have enough to do without wasting time dealing with this $&^%&$.

A friend of mine received a traffic offence notice a couple of weeks back, but he nor his gf were driving the vehicle at the time. The only explanation is that someone got hold of the keys that evening and went joyriding. He tells me he left his keys in the front door before he went out, and there was no reason to suspect the car had been used when they next used it. They are being treated as liars by the Police, and it looks like it's going to court now. The gf said she was willing to pay the fine and accept responsibility to avoid hassle, but she wasn't allowed to because she wasn't actually the driver.
Can any legal heads drop in with some advice?

Yeah. Tell your mate to stop lying and take the points. If he persists in this, it can change from a simple motoring offence to "Perverting the Course of Justice". At that point, it then becomes a serious offence which can result in prison but at least would have to be something he would have to declare on job applications where it asks about a criminal record as he would have one. If his girlfriend also insists on backing up this farcical pack of lies, she can also be charged and convicted of the same offence.

The crunch point usually comes when the Police get the photos back which identify the driver at which point they ask the driver if they still want to stand by that fabricated story. What they tend not to do though, is tell you they've got the photos until after you've said you stand by your statement.

What a sweet girlfriend wanting to pay up just to stop the hassle.

Im getting aload of hassle from the missus because I wont buy her a Ferrari, dont suppose the girlfriend will cough up "just to save the hassle" sweet girl.

No wonder the Police don't believe anyone, wait for the "We have never ever been in trouble before and cant understand it bit" Attempt to Pervert the course of justice could be on the cards, but I bet it was all an honest mistake.
  • Have to agree with connor,I would think there was more chance of the car being abducted by aliens.

And he could ,as said ,get into real trouble if he is telling porkies
:) There are two sides to every story.

i know someone who had 6 points on their licence and went through a red light. He received a fine through the post saying he had been caught by a camera doing the offence blah blah blah. he then got his girlfriend to send in her details to have thepoints and fine for him, she then received the letter stating they have photographic evidence that SHE was committing the offence when clearly it wasn't her and they obviously didnt cjeck with the photographic evidence to see if it was her or not. ( you could've seen who it was, he's bald she's got big hair!!)

Let's not leave out perjury which is what the lovely BMW finance director was found guilty off when given a 1 year ban and 6 weeks in jail... For claiming it was his 19 year old son that was driving...

Must point out that failing to provide details is now an offense, in which itself can be awarded points and a fine on the driving license.

The person who the car is registered will be responsible to prove that it was not himself / herself that was driving the car. If the cannot then they themselves will be held responsilbe.

Feel free to get your partner to take the points, but as this is a internet forum, and comes under google, id be weary.

Stole car keys from door, used car, put keys back.. - i smell bullsh**.
