You clearly didn't look into S75 as you said you were going to did you?
  • Thanks for you help and sorry for my lack of understanding of it.

Just re-read that a seems to good to be true says whole amount is covered even if I only paid £1000 on card. Really? What will they do?

First of all you need to inform the credit card company of the issues you have......get on the phone to them asap.
  • Did that yesterday claim form is in the post, what if I pay the card off every month then no outstanding credit?

The credit card company will reject your claim.

You have a major issue here. You can't just outright reject the car, it's been too long. You can reject the car after a failed repair attempt but currently they haven't made this attempt. However they're offering to carry out this repair, it's you that's telling them not to. Frankly the timing of the issue appearing is irrelevant. If they were to carry out the repair and it went wrong then you'd have the right to reject the car so in your shoes I'd be asking them to fix it. If it's a satisfactory repair then you get the car you want, if it's not then you get a refund. Either way you win.

However I suspect if this was to go to court you'd lose, with a hefty bill to pay and still with a broken car. Them offering to fix it has somewhat screwed you over.
  • This is the second repair on the car, it developed an e-brake issue just after I got it that was fixed. Citizens Advice told me that as it's second repair can reject under final right to reject.
  • Re s75 claim, It doesn't matter if you no longer owe the money on the credit card.

Is that right to reject not for a second repair for the same fault.

Yes it is, maybe I should have made that more clear in my post.
