Very well done, thanks for letting us know.Hi all
They didn’t show and I was awarded my costs, so I guess I won!
Could you give us a little bit more info like name of the Judge, which court (town/city), what the Judge said, on what basis was the claim dismissed etc?
ANOTHER ONE BITES THE DUSTPlease note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

The court was provided with a letter advising that CEL wouldn’t be attending but they would be sending a representative.
I’m surprised no one showed. The hearing could have been called off due to a double booking and when I spoke with the court they informed me that they had spoken with the claimant and they did not say they would be withdrawing.
As no one showed the judge said he was going to strike it out. He then asked if I had incurred any costs to which I informed him that I had included a schedule of costs in my witness statement. He took a look through and (I think) decided to award me the full value bar 2 hours litigant time.
He was clearly very unimpressed that no one turned up and was very aware that I had taken time to put a defence together and actually attend the hearing.
Does anyone know the best route to go down should CEL not pay up?0 -
So what figure costs were you awarded? I think it’s around £1400 -
They'll pay up
If they dont, warrant of control from the court. You pay and it gets added to their bill
Never known CEL to not pay.0
