NCP BW Legal County Court claim issued despite NCP cancelling charge

    Why not download a blank Notice of Discontinuance and fill it out for them. Send a copy to NCP and to BW inviting them to complete their bits and send it to the court - and then confirm to you.

    That's no compensation for the stress your husband has
    suffered and yourself.

    NCP should have jumped at the chance to immediately
    apologise to you and tell you that their wild dogs,
    BWLegal have been called off.

    Rather proves how ignorant and arrogant NCP are, and
    that is pointed to the directors of NCP.

    With NCP now using BWLegal, this will a continuing
    problem for the BPA

    NCP should be sanctioned by the BPA for this disgusting
    episode

    Tell your husband this is over so no more stress.

    It's such a shame that NCP are behaving like spoilt
    children and not being professional

  • I’ve just logged onto MCOL and can see it has been discontinued. Just feel slightly aggrieved that NCP don’t feel it necessary to respond. Surely BPA, and particularly at SC’s level, cannot be expected to step in and respond for them on every complaint.

    Hopefully though now at least my husband can relax a bit. I’ve sent the screenshot from MCOL

    In a real world you are right but the BPA do not live
    in the real world. Steve Clark seems to be the only person
    in the organisation that understands and therefore he is
    the only logical contact.
    It is the BPA's responsibility to control their members and
    it's because they fail to do this, is the reason that one MP
    classed them as a multi storey car park in the Gobi Desert

    It's a private members club who turn a blind eye to
    their members who scam the public with lies, fakery
    and attempted extortion

    I am glad this has been discontinued for you, there was
    no other outcome. Don't think for one moment that the BPA
    is squeaky clean ..... they are not

    Phew!

    I think it's still worth a complaint to the SRA. BWL didn't act promptly when told by their client to discontinue, and caused you stress and anxiety as they blundered on in their own little world.

    You could either accept the offer of 'free parking' as compensation, or:

    - you might like to send NCP's Data Protection Officer a SAR, and ask for all data and photos and all communications about you/your car and this case, including all comms between NCP and Mr Clark and an explanation of how this happened.

    - then decide if you fancy a punt at taking them to small claims for, say, £500 compensation for your extreme distress caused by this harassment and breach of the DPA, with untimely and unjustified processing of your data to frighten and intimidate you and your family with a court claim after 'cancelling' the charge.

    Parking firms really do need it up them, especially in cases like this (even when Steve Clark has done sterling work to achieve this much) it is an insult for NCP to hide behind him, not apologise themselves, and simply to offer 'free parking' that costs them pennies/arguably nothing at all...

    Do the SAR to find out more. Then decide, do you fancy a small claim punt, minimal outlay, maximum effect and hopefully recompense that is more meaningful to all parties.
