I've no idea what Tesco expect but if you pick up a single red pepper, weigh it, print a price label and it says 41p that is what you will get charged at the self service or other till.
If you pick up a red pepper from a shelf which states '55p each' weigh it (regardless of whether the picture is a red pepper or not) and pay 41p, thats stealing0 -

No it isn't! If tesco have two different prices for the same product then that is their mistake and you are under no obligation to choose the higher one any more than if a pack of meat had 2 labels on it you would legally have to scan the higher one to avoid being charged with theft.

Its not being offered for sale at a 'price per kilo' weight though. They are 55p each.
The item does not have two labels on.

Tesco quite often promote loose red peppers at 41p (it's 25% off the standard 55p) when they are featured in the current "Food Love Stories" recipe.
It sounds as though they had changed the shelf pricing as they were due to come off promotion, but they were still in the till system at the promotional price.0 -

You've taken the analogy too literally - I know it doesn't , literally, have 2 labels on it but it is being offered for sale at 2 prices! It is not an offence to choose the lower price.0 -

But its not actually being offered at that price. It says 55p each. All the other items say 'price per kilo' or whatever, so you trot off to the scales.
You can't just randomly start weighing things if they are not offered at a weight price.0 -

Right next to the peppers the price is clearly displayed as being 55p each.
The price of 41p each is stored in a computer system away from the peppers and 3 members of staff clearly said this price does not apply to this product.0 -

No , tesco INTEND the peppers to be sold at 55p and the staff reflect this intention however due to tesco's mistake they are , in fact, offered on the scales too (unless, of course, they sell more than one type of loose red pepper but assuming only one type of loose red pepper is available then it is being offered at 2 prices)0
