    Leaving a car park is unlikely to stand up in court as a breach of contract. Many judges may even regard it as an unreasonable term in a consumer contract. Supposing your £300 Panama blew off the site, is is not reasonable to go after it? MPs feel the same.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P.
    for unprofessional conduct

    Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the House of Commons recently

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.
    You never know how far you can go until you go too far.
  • still a good idea to pressurise Aldi into cancelling, posts on this forum indicate Aldi do this as a matter of course if you can show you were using the shop (regardless of whether you left the site).


    The planning stuff may well win at POPLA but a simple email from driver to Aldi may also work. Has the driver got a receipt, or a bank/credit card entry showing they were shopping there?


    Yes the PPC is confused about what it's alleging, it sends a photo indicating its the white line but tells you it's because driver left the site, so they are misleading but POPLA won't care about that I don't think.


    I'd do both if I was you (POPLA on the basis of the planning as well as no breach, plus Aldi).

    If the scammers are saying that the motorist left the site, do their signs define the site boundary? Is there a map of the site?
    How does a motorist know if they are within or without the alleged site boundary?
    If a motorist was observed about to leave the site, why didn't the parking weasel stop them and warn them?

    If the local planning department said that parking is allowed for motorists to visit other shops then it follows that they are permitted to leave the site to do so.


    Complain to Aldi about this unregulated scam as advised, and complain to your MP and the MP where Aldi is located as well if different.

    So what are you confused about? When you sent the first appeal on day 26, I said:
    Wait the requisite 26 days - you know WHY, because the NEWBIES thread explains 'why the delay' which I will not repeat all over again here.

    And you just confirmed:
    nothing in the post.
    So if you understood WHY you delayed and appealed as keeper, you will know why ''nothing in the post'' means you will win at POPLA and how to word it.

    Please revisit the NEWBIES thread 1st post, where I explain WHY you did what you did, on day 26. Think about it...the tactic worked...so you only have to get to day 56 and - a registered keeper appellant WINS at POPLA after that, you know you do!

    as above, CARE are notorious for not sending an NTK because even after 6 years they have no idea about POFA2012, so use that to your advantage


    the popla appeal needs to be done and sent in by day 33 , not day 28 , BUT try to ensure that this POPLA appeal is uploaded AFTER day 56 following the windscreen ticket


    So mark down day 56 in your planner or diary and see if the popla appeal deadline is AFTER it , then plan the date that the appeal will be submitted


    there was a recent METROLINK one where CARE hadnt sent the NTK until around day73 , hence they failed POFA - YOU WANT SOMETHING SIMILAR
  • Sorry to ask but getting a bit lost in the newbies thread. About to submit my popla appeal, do I just use the standard template letter no NTK received or is it recommended to add other stuff signage etc?

    Have you read any of the PoPLA appeals freely available in post #3 of the NEWBIES FAQ sticky thread?

    It might be a good idea to post your draft PoPLA appeal here for critique before sending it to PoPLA, but it's up to you of course.
