Issue after Selling the Property

Hello
I recently completed a sale of a property in Manchester. Three days past the sale, the estate agent reached out to me and said that there are issues in the house and asked for permission to provide my contact details to the buyer so that it can be dealt with me directly, for which I said No.

Also, as the buyers consider the problems as serious the buyers are asking for my home insurance for the property so they can make the claim. I do not wanted to be contacted and also what are my obligations after the sale.

I did not visit the property since it was put on sale 6 months ago and not sure when did the problem actually happened and it may have well happened after the exchange of contracts or even after the completion.

Please can anyone advise what need to be done here and how I can be helpful for the buyers for their problems.

    If they had any material claim to make I would expect them to be doing it via the solicitors rather than the estate agents. Hard to tell without knowing what the problems are.

    I wouldn't have thought you were liable for the property at all after selling. When your buyers had the survey done as part of the purchase process it should have raised any possible issues and they should have then tried to get the price lowered or negotiate a deal with you on getting some things fixed. If they didn't do that, then I don't see how you're at fault.

    If you were renting the property to them, then yes as the landlord you would be responsible, but you sold the property, your insurance on that property would likely be invalid now, and the new owners should have their own insurance

  • I dont understand how your insurance could be relevant to them. They are not insured under your home insurance, which has presumably also been cancelled.

    I would probably tell the agent that they are only authorized to provide my email address only (if this was not linked to work). You don't have to reply to them - but if you can be helpful without getting involved it might be friendly to do that.
  • If there is a huge crack, then it is highly unlikely this is an issue for you to get involved with

    You won't have given any warranty about the condition of the property. Unless they are alleging that you caused the crack between exchange and completion then i can't see how you are relevant to this.

    Check your contract of sale.

    If the solicitors used the latest standard contract (5th edition), the risk passed to your buyer on exchange, and they should have insured the property themselves from the point of exchange.

    (They couldn't claim on your insurance under any circumstances, so asking for your policy details is just plain silly. If for some reason they have a claim, it's against you, and YOU would claim on your insurance. But it's unlikely they do.)

    Have they explained why they think the huge crack in their house has something to do with you?

    Unless they specifically asked in the SPIF if there was a crack in the house and you replied "no" when there was, then you have no liability for any problem discovered post sale.

    If they did not exercise due diligence, did not use their eyes, did not employ a surveyor and did not inspect the property post exchange and pre completion, then anything found post completion is for them to deal with.

    Do not engage in conversation or e-mail exchange, ignore them completely.
