Because the space on the N180 questionnaire is limited, could I write a sentence below the signature stating after the 31 August I will not be available? on the form I wrote not available from April - 01 July. Then I return home with my kids 31st August for school.

Yes, but put an asterisk in the 'available dates' box and an asterisk beside the note, too.

    Good morning guy's,

Its been a while. So Regarding our last conversation fast forward to now A date of 15th of last month was given which I was not able to attend as I live abroad. I did not request that time frame because me kids would be in school here. So the court is now requesting that i pay £271 by 29th of november. My sister only collected these letters yesterday. How can I go about rectifying this? Is it too late for me?

I would hate to give these people money I do not have or even around in the country at the time for such allegations to stick.

What can i do??? Thank you.

It looks like a judgment in default. You need to act quickly but it should be a mandatory set-aside due to the CCBC's fault. Search the forum for six-point draft order and set-aside. You need to download the form N244, complete it with your six-point draft order, witness statement and a cheque for £255 (which hopefully will be returned) when you win. The biggest factor in gaining a set-aside is to act promptly after you discover the erroneous judgment.

Are you living abroad on a relatively permanent basis? Do you have a home in the UK as well?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

So you lost be default by not attending a hearing on 15th Nov, and don't tell us you didn't put in any evidence or a witness statement either, despite the local court requiring that in advance?

If you live abroad, does a CCJ in this country matter to you at all?

Then the advice in post # 106 is still current. Have you started the set-aside process yet?
