Car Accident emerged from left onto main road

    Friend of mine learned the hard way when a car indicated but didn't turn and friend pulled out from a side street....friend 100% liable. His insurers said even if he could prove the indicator was on, all it would do would split liability between the two parties rather than absolving him of it.

  • I wouldn't worry about it same happened to me from the opposite view point I was pulling out car on main road DID indicate (independent witness) and the whole lot was pinned on me. I hoped to get it 50:50.

    I was partially at fault because I pulled out when it was unsafe to do so, but they decided it was 100& down to me (hardly worth fighting it).

    They could have been indicating they were going to pull in to the left of the road, rather than turn, or they could simply have left their indicator on by mistake.


    Sounds like HC rules 103 & 104 (https://www.highwaycodeuk.co.uk/signals.html), with emphasis on the "proceed only when you are satisfied that it is safe" (in my town most people don't indicate incorrectly, so you can't trust them!).

    My friend was gutted, his car was only 6 weeks old. He now follows my example and only pulls out once the car has slowed & started to turn.

  • My car was only 8 wks old too... im devastated....

    My dad was a driving instructor for over 30 yrs... he drummed into us all never pullout from anywhere unless 100 pc safe to. Take no risks or chances. And never trust or rely on indication. Make sure they have commited to turning and are turning, even then there could be another vehicle close behind that could hit you.

    to be honest i dont pull out unless they have turned and it is clear.

    i am also a motorbike rider ..full bike licence for over 30 yrs and I cycle and have cycled all my life... I know there r idiot motorcyclists n cyclists too... but i believe if more people had experience of motorcycling or cycling it would make them more aware of the dangers on the road...

    i came off my motorbike only once.... an old man not looking stepped off path onto road... road was wet ... greasy i broke ... swerved and missed him and went down ..
    only 20 mph.... it hurt.... he didnt even come n see if i was ok.... the bike was stuck on top of me ... some firemen viewed n came n helped me...

    my dad agrees with what you are all saying on here... i feel gutted that it happened. i am not claiming for personal injuries i am fine apart from upset.... all i want is my nice new car back...

  • there are no skidmarks on the road and the airbags were intact ... so i was driving within the 30 mph speed limit.

    Yep - caught by someone else's silliness.


    Likewise, I tend to wait until I am sure that the person is making the manoeuvre their indicators suggest.

    His driving instructor almost certainly told him that, probably on the 3rd or 4th lesson.

    As others have said, whether you were indicating or not the insurers would find them at fault as you had right of way. The fact she pulled off a stupid move is entirely her fault. Hope you get the car back in perfect condition very soon, I know how gutted I'd be if it were my new car :-(
