Car Accident emerged from left onto main road

Hi
I was driving along my usual main road to work, I was continuing straight and saw 2 cars at a give way on my left, coming from a lane. one behind each other, waiting, I continued . all of a sudden the first car pulled straight across me heading for the lane exactly across the opposite to where she came from, cutting through my right of way . the speed limit was 30 I was travelling at round 25-30 mph. I slammed my brakes on, I couldnt swerve in as the other car behind her had at the sametime moved to the giveway lines, I just missed him and clipped her drivers side back bumper. Hardly any damage and my rh wing is wrecked, lights wrecked and bumper wrecked.
Apparently she is trying to make out I was indicating, I was not....the witness in the car behind has stated she was clearly in the wrong and pulled out, he saw me coming and was not aware of any indication.

The witness also says the sun was directly in their eyes as they looked to their rightd & quite low making it very poor visibility. The third party muttered to me as I left I thought I saw your indicator ......I told her that I was travelling straight onto work, why would I have indicated, there was no indicator, the sun must have been in her eyes....:beer:

Seems fairly obviously the other parties fault and backed up by an independent witness. Keep in regular contact with your insurers for updates.....0 -
You were on main road, car pulls out across give way line. Pretty clear cut as long as you have an independent witness.0

I was taught not to trust people's indicators and wait until they started their manoeuvre. Hopefully you took photos? If it clearly shows her car having crossed a give way line, I don't see how she can argue it - even if you were indicating.0

The law requires that you do not cross the give-way line "... in a manner or at a time likely to endanger the driver of or any passenger in a vehicle on the major road or to cause the driver of such a vehicle to change its speed or course in order to avoid an accident."
The other party is clearly at fault. As for your allegedly indicating, the Highway Code (rule 104) tells her to "watch out for signals given by other road users and proceed only when you are satisfied that it is safe".0 -
I have an independant witness yes ......thanks He was in the car behind her, and he saw everything even me approaching and saw her pull out and stated he did not see any indicating.:beer:

Do you have a dash cam if not, i would highly recommend you get one and get it hardwired in, at times like this they will pay for itself
unfortunately, people will admit liability at the road side but as soon as they have spoken to thier insurance company the story changes, it hard to deny video evidence“People are caught up in an egotistic artificial rat race to display a false image to society. Do you have a dash cam if not, i would highly recommend you get one and get it hardwired in, at times like this they will pay for itself
Indeed, just a few days ago someone phoned my office to say I flew through a red light ad nearly hit them. I informed my employer I proceeded with care through a signal stuck on red and I would download that section of recording for them to review. Recording showed no relevant vehicles or pedestrians, only a woman sitting behind my who didn't follow me through the stuck signal.
Go figure the siht that could have started if I'd no recording of events. I drive around 45K a year between work and personal, I've always got a camera recording.Don’t be a can’t, be a can.0
