Falsely accused of fly tipping

  • It's possible that the lost card was found by the person who did the fly tipping and possibly tried using the points on it? Upon finding that the card was not useable then dumped it with the rubbish.


    While on the subject, if you have rubbish removed from your premises make sure the person/company that removes it has a waste licence otherwise this could be you next.

    On the balance of probability what has probably happened is that somewhere along the line some of you're waste has been dumped illegally by a waste carrier

    This is a huge problem because unscrupulous waste carriers do this and often it's subcontractors who subcontract type of thing and they do just dump it and this practice has increased and is more and more common.

    Going in with the mindset of proving your innocence is totally the wrong move.

    You made a sweeping generalisation about two professions. I pointed out (implicitly) that it was a generalisation, to which there are exceptions.

    I was not claiming that all nurses and postmen are evil, whereas you were implying that all nurses and postmen are saints.
    The OP, writing hurriedly in her break, was trying to indicate that she and her husband don't usually do heavy building work or have access to a tipper truck.

    It was someone else who made the assumptions, generalisations, or whatever you want to call them.

    Only the OP's card was found, not other waste. Probability doesn't matter, it's not difficult for someone to see the card on the ground, pick it up and see it's not good. Then see a pile of rubbish and toss it with it. People litter all the time.

    I work for a council in that service area and I know how much it costs to clear it up. Most ( not all - but most) will have a policy to interview anyone whose details they can find in fly tips. Though most cards don't actually have an address on them, and data protection laws would usually stop the company concerned from passing on your details on so I'm not sure how they found you. Usually when something with an address is found - a letter for example -the address is that of someone who paid someone else to get rid of rubbish in the belief it was being done properly. These people are generally fly tipping on an industrial scale, and if they can be caught and prosecuted councils can get their vans crushed as well as any fine that might be imposed. If you can prove you didn't have work done, were out of the country and had reported your card missing, you have nothing to worry about. if you cant you could get a fine for using an unlicensed waste carrier - but its highly unlikely

    Is that all the evidence they have, an old costco card lol. I found an old co-op card at the bus stop.... Which led me to belive the person on the card built the bus stop. LOL

    I was under the impression that if you attend an interview under caution voluntarily you are not entitled to free legal advice. It is not the same as being arrested and taken to a police station. You can of course have a legal representative with you.

    An investigator is obliged by law to consider all lines of enquiry. If they suspect it was Mr X who was the fly tipper they cannot ignore the fact that a Costco card was found at the scene in the name of Ms Y.

    Otherwise they get to court with Mr X and he just says, it wasn't me and they found evidence linking to Ms Y. Immediately there is doubt and a jury will be directed not to convict a defendant unless the prosecution case is proved beyond all reasonable doubt.

    They can't discount Ms Y until they hear what she has to say, or not as the case may be.

    OP mentioned that she can get advice through her union. That being the case, attending the interview with her solicitor and proof that she reported the costco card as lost, and that she was out of the country when the tipping took place, would probably be sensible.
