    It can't as paragraph 7 section (4) (POFA2012) states;-
    "The notice must be given—
(a)before the vehicle is removed from the relevant land after the end of the period of parking to which the notice relates, and
    (b)while the vehicle is stationary,
by affixing it to the vehicle or by handing it to a person appearing to be in charge of the vehicle"

But irrelevant to a scammer when they smell coin! Can you imagine your average parking chimp understanding any of PoFA?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

parking companies issue pcn,s for all manner of irrelevant issues, they dont let legalities stop them issuing tickets as they think joe public is so stupid that they will pay up regardless , even if they banned blue cars on a monday and pink cars on a friday

the only time the laws are tested are in court, before a judge , or if the MCOL POC are so ridiculous that its struck out by the initial judge that decides if it should proceed or not

only the court case matters, until then its he said , she said

Great, I expected that was the case but didn't have time to check.
Obviously you need to include this when you write to them. When the driver moved the car, was anyone else present who can make a statement to confirm that there was no windscreen pcn on the car at that moment?

  • OP, can you confirm that you have not identified the driver to Millenium?
