Parking at my apartment

Hi all,

I recently became the leaseholder of an apartment which has an allocated parking space. Unfortunately, I don't have a copy of the lease with me but the only mention of parking in it is that there is a space allocated to me for my use that can be changed if I have disability requirements. There's a terrible diagram in the lease and the space has a small sign with my apartment number (nice to know everyone will know when no-one is home!).

My car was parked in the space and this notice was placed on the windscreen [sometime between 17 and 19/08/18]. No permit was displayed on the car.

The notice is below, change the x for an s, the reverse side is blank.

This rather annoyed me so I wrote a letter to CMS and sent a copy to the management company of the apartment block [19/08/18]. In it I described that my lease is the primary contract and it cannot be unilaterally overridden by CMS. I also stated that I have never given consent to CMS to operate on my space and never will and any such actions would be considered trespass. I didn't mention the windscreen ticket in the letter.

Again, I've not got a copy of the letter with me but I will upload a copy if it would be useful along with anything else.

Hopefully I've not jumped the gun by sending the letter, any advice would be appreciated.

    wait and see if they issue an NTK now, or any other paperwork

    I suspect they wont go away that easily, so google UKPC vs DAVEY SUCCESS and see what he did about his "own space" , and keep on at the MA about it too

    Do you know if there is any law that requires MAs to act in the best interest of leaseholders? I would be very interested to determine whether the MA get kickbacks from each parking charge.

    Could there be another entity that entered into the contract with CMS and not the MA? e.g. the landowner directly - if it is different to the MA.

    I dont have any knowledge on the law itself etc, but I would suggest you read a few "own space" threads on here that go into these details , like some court case threads and the debate about "alleged kickbacks" that raged on here recently

    there are NO new topics in this saga , its all been debated over the last few years , including by the MP,s in parliament and the committee rooms over the last 12 months


    so more research will help , try the drop down search box too

    That sign really is poor.

    The £100 charge is almost invisible.

    Compare that with the Beavis sign:

    that sign clearly mentions parking permits , so the MA must have some knowledge about this plus the power to cancel erroneous tickets too

    clearly your vehicle was ticketed due to no permit on show , despite it not being in your lease, a typical residential parking issue

    see those other threads I linked in my last reply, plus find and read the hairray thread too , for enlightenment in this murky world of contracts , sub contracts and contradictions when it comes to private residential parking
