PCN with PE Stage 1 - Should I include photographs at this stage or examples?

  • @Le_Kirk - I have just received my POPLA number, I am just looking to put together everything I possibly can as per the newbie thread "ParkingEye don't like the kitchen sink approach". much of my current appeal is based on a successful appeal, do you think this is incorrect? It's entirely possible I am running down the wrong path in an attempt to get everything together

    @Redx - I am not 100% sure what you mean, i.e. why would this result in the PCN being cancelled?

    @tboo - Yes it is, I have linked back to this thread but if there is a better way to do it please let me know!

    Putting together your appeal based on other successful appeals is the right way to go, it's just that what you posted could have been a defence or a witness statement.

    The reason for dropping a SAR is to get all the information the PPC holds about you - forewarned is forearmed.

    Better to keep all information about ONE incident in one thread as it stops responders having to jump between two or more threads. Send a PM to a board guide (Crabman, Savvy or Soolin) and ask them to merge your threads.
  • @Le_Kirk - Thanks I will send them a message now, I have updated the document but haven't yet included anything from my witness, essentially they can attest to the signs being damaged at the time (although I have provided a photograph) and that signs were not visible from their position inside the car park.

    With regards the SAR - they have 30 days to respond but would I not need to submit my POPLA evidence before then leaving me without that information anyway?
  • Instead of playing what ifs, why not submit the SAR anyway? You might get it back in time.

  • @Umkomaas - thanks that is a lot better than the ICO one! I will be doing it this evening as it seems everyone is including the V5 as evidence and I don't have it to hand.


    With regards my document at the top of the thread - at this stage is a witness statement pointless? I was thinking something along these lines:

    My Witness <Name> states that they saw no visible signs from their position inside the carpark on the day but did note that there was an extremely damaged banner which she believed to be a promotion of some kind.

    Also currently I have included this section : The operator has not shown that the individual who it is pursuing is in fact the driver who may have been potentially liable for the charge

    but PE did send letter out with the POFA on the back, I couldn't even pretend to understand this but I assume this section isn't relevant as a result?

    I never said it would get it cancelled nor did I say it expecting that to happen either

    but once you have all their evidence you are in a better position to defend it (or appeal it)

    plus it gives them a job to do which I consider is worth it seeing as they are putting you through the wringer
