That WS from Ashley Cohen is quite dynamite considering he is a director of Bemrose Mobile (the pay by phone company) and doesn't explain his connection with the Claimant company in this case, which is Versatile
He has certainly known to be 'creative' in his time
Considering the Ntk seems to be completely from Versatile Parking Ltd, who broke away and joined the IPC in 2016, what is CEL doing writing the WS.
So as members of the IPC Versatile, sorry are able to get keeper details.0 -
I do believe that the claimant's witness has omitted a vital part of the judgment or Roch LJ in Vine v LB of Waltham
The presumption on which they apparently rely is rebuttable and not to also draw that to the attention of the court is, inmho misleading. My emphasis below from the judgment...
Normally the presence of notices which are posted where they are bound to be seen, for example at the entrance to a private car park, which are of a type which the car driver would be bound to have read, will lead to a finding that the car driver had knowledge of and appreciated the warning.0 -
