Everyone is politely asked to read up on this in the newbies FAQ thread near the top of the forum before starting a new thread

Do the post office not log it as tried to deliver - hence they can enter that as proof.
If we can force them to make this extra step - it is one more expense for them
Tried to deliver proves not delivered!
The post office don't offer a service to show the recipient was handed the letter!0 -
I was about to do this - I thought the steps were
1. get gov gateway ID
2. Set up thread here
3. do Aos
4. read replies from members (you guys are great btw)
5. Submit defence
Now from replies in here so far the final steps
6. Await judgement
7. Either walk away scot free - or pay within 30 days
8. Case closed - nothing on file anywhere.
Please correct me if I am wrong
But all that, and more is comprehensively described in post #2 of the NEWBIES thread.0 -
Also, its entirely pointless discussing this here. Youre not going to get anything changed for THIS CLAIM, which is what is important.
You need to get a defence together
This defence can be ENTIRELY different to the appeal, but obviously cannot say anything that contradicts teh appeal.0 -
I am not sure what defence to mount as NCR probably own the land so are a bid different to all the other claims here (please correct me if I am wrong on this) The Claim on the form is as follows:-
The Claimant's Claim is for the sum of
£247.88 being monies due from the
Defendant to the Claimant in respect of a
Parking Charge Notice (PCN) for a parking
contravention which occurred on xx/09/2017
in the private car park/land located at
Hemel Hempstead Hillfield Road Herts HP2 4AA,
in relation to a vehicle
xxxxxxx
The Defendant was allowed 28 days from
the PCN Date to pay the PCN, but failed
to do so.
Despite demand having been made,
the Defendant has failed to settle their
outstanding liability.
The Claim also includes Statutory interest
pursuant to section 69 of the County Courts
Act 1984 at a rate of 8% per annum (a daily
rate of £0.04 from xx/09/2017
to xx/08/2018 being an amount of £12.88.
The Claimant's claim includes £60.00 costs
as set out in the Terms and Conditions.0 -

........... hence why it was suggested that you read the Newbie sticky about small claims court and in particular to search for examples and then produce your own stout, robust, reasoned and well argued defence. Stick it on here for critique before submitting.0
