    Keeper received a letter from BW Legal saying last chance to pay, will get a CCJ, etc.

    I know this has been asked before, but if a CCJ was made is it 100% correct that it will be struck from records and will not affect credit rating if it is paid within 30 days?

    BWLegal cannot give a CCJ. They think they will, we think they will get spanked in court again

    I am not sure that the judgement ever actually goes on record if you pay in the 30 days. I was told by the court that unless the Claimant advises the court that payment has not been made then nothing goes on file.

    Nothing went on file in my case and I know that the Claimant did not advise the courts that I had paid or sent me a receipt. I did though send the court a letter from my bank to say that I had paid. I have checked Experian regularly and there are no issues with my credit history.

    Can i ask for some guidance on how mediation works and whether it is worth pursuing? I am not the keeper of the vehicle, I am only trying to help the keeper, and i know that they'd prefer not to have to attend court. 
    Can a court hearing be heard without the Defendant present? assuming the court was given notice?

    As described in the NEWBIES thread, don't bother with mediation.

    Yes a case can be determined in the Defendant's absence. Give the court at least seven days notice. However, the Defendant will be at a severe disadvantage - not being there to challenge any rubbish the Claimant's representative may spout on the day.
  • all it seems to say about mediation is that it is run by a private company who are motivated only by keeping cases out of court, which sounds reasonable enough.
    So if keeper wrote to court and said they couldnt attend this is entirely lawful?
  • by the way, last month i wrote to the Dept of Transport and asked them directly about the use of ANPR in local authority car parks. It is quite an interesting answer so please let me know if i should post it on this forum.
