  • Hi Coupon

I've lifted the verdict from that case as it was written and it says "knowingly" already.

I will add a line in the description before the quote to make this clearer.

thanks for all your feedback so far. Are you able to address my other point as well? I want to scan this and send tomorrow at the latest as deadline is Monday.

I know, but it DOESN'T say that it was about the same Claimant. Spell it out!

    What was your other question?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Nope, read the rest of post 2, so you:
    1) know whats coming next
    2) can prepare for it so it isnt a surprise and
    3) know that IF SOMETHING IS MISSING that it is missing. For example, if you dont kow the DQ MUST be completed, and it gets lost in the post, you lose and get a CCJ against you that you need to have set-aside. If yo uknow to expect the DQ, and it does not turn up, you can simply download one and send it to the claimant and the court.

Good advice. I'd even be minded to download one anyway and prepare it, so that the info is ready for final review before sending. I'd be minded to do likewise with the Witness Statement while everything is fresh.
  • so next i would expect a hearing date to be confirmed at which point the Defendant has up until 14 days prior to submit Witness statement and evidence?

how do you download the DQ?

One other question, if the Defendant didnt wish to/or was unable to go to hearing, can they appoint a representative?

    thanks

Yes, but said representative would have to have Right of Audience to represent their client without the client being present. Thus a barrister or someone with equivalent status. You couldn't just send Uncle Jim.

You can of course have a Lay Representative to speak for you, but you'd still need to attend the court.
  • Keeper received a letter from BW Legal saying last chance to pay, will get a CCJ, etc.

I know this has been asked before, but if a CCJ was made is it 100% correct that it will be struck from records and will not affect credit rating if it is paid within 30 days?
