I'm gutted! On my account page it's changed from 'in progress' to 'Refunded or Payment Cancelled', and I've just had an email saying the same. So disappointed I will not be getting this.
(Anyone got one they don't need btw?)
  • I thought if they took the money they had to honour it, can anyone confirm this?

I've just tried to phone them about it but their phones are down until Mon.
  • harry, what's their phone number? I couldn't find it on their website. I wouldn't normally bother, but in this case, I'm taking it further.

I placed my order ages ago (1st November), when the item was showing as in stock. My order went onto back order the same night. On the 12th, they took payment from me and my status changed to in progress. I can still order this boxset via their website, so the issue isn't that they are out of stock. Others have received their orders already. So, if it was a mistake (which they will argue it was), why take the money 11 days after I ordered? Why send out box sets to other people? If it's out of stock, why can I still order it from their website? Their terms and conditions state that a contract isn't formed until despatch. However, I would argue that the postal rule does not apply in this case, and that a contract came into place when they took the money (consideration), as they had plenty of time to cancel my order and did not need to take the money 11 days after I placed the order. They also state that they won't take the money until the item is ready to be despatched. If that's the case, why was the money taken on the 12th, then the order cancelled on the 15th? The email sent to me offered no explanation as to why the order was cancelled. As far as I am concerned, a contract is in place for them to supply me with what I have ordered.
In a rut? Can't get out? Don't know why?

The get out for them is this part of the t's and c's -

    Contract Formation
When you place an order to purchase a product on our website, your order is an offer to purchase those products. We will then send you a confirmatory e-mail setting out the details of your order. A contract will only come into existence in respect of each of the products ordered when we send you an e-mail confirming that we have dispatched those products to you.
  • I got my money refunded too, am sooooo gutted.....my son is Dr who mad and I was made up when I thought I could afford him a boxset
They've got cars big as bars

See, due to the circumstances surrounding this issue, I would say that their get out won't apply. They also state that they won't take the money until the item is ready to be despatched. They took the money from me on the 12th. Where's my item? As stated in my previous post, they've had plenty of time to cancel these orders without taking the money. Why did they not just cancel before? They've also made it impossible to contact them via phone (down today and tomorrow for "essential maintenance" - yeah, right). Their website is down, too.

Anyone's else's £6.99 taken and then refunded? I was wondering if someone from MSE could look into this, as they did with the Littlewoods code issue?
