Brake cable broke on daughters pram!

Good Afternoon,
I need some advice as I'm upset and confused!
The brake has snapped on my daughters pram, luckily she was unharmed!
After checking the brake, I found that the metal cable inside the brake itself had snapped!
Upset, I contacted Mamas and Papas, only to be told they basically won't do anything as I cannot provide proof of purchase?
To me, this is a serious incident that could have resulted in tragedy. It's not a flimsy bit of plastic that has snapped but a metal cable?!
I have kindly requested a replacement break and they have refused to acknowledge any fault, unless I can provide proof of purchase, which I cannot.
I'm confused with my rights...as I have read if it's faulty then warranties and proof of purchase do not matter from up to 6 years after the item was bought?!
Can anyone help me with this please? One of Mamas and Papas motto is "safety is key" and I'm genuinely appalled by the way I've been spoken to!

    I think you're perhaps getting confused. A retailer cannot insist on a receipt to enforce your statutory rights (they can insist on one for a warranty claim, if thats the terms of the warranty). However they can ask you to provide proof of purchase which is basically to prove the existence of a contract between you, because if there is no contract between you then you have no statutory rights against them.

    Totally wrong .
    6 years is in effect the time scale for court action .
    Its not a free fix everything for 6 years .


    When did you actually purchase the item .

    Without proof of purchase they could just as easily assume you got the faulty pram from Gumtree or free cycle etc.


    Basically you have no rights despite what you seem to think.


    The six year rule that you seem to (not) understand is very misleading as it seems a lot of people think it's as easy as that. The bottom line is it's actually very hard to enforce this consumer right without understanding it then jumping through all the hoops needed to enforce it.

  • Thank you for those who (politely) replied, to help with something I had clearly said I was confused with...

    The pram was purchased at Mamas and Papas...which is even more frustrating... as they have record of my other purchases I have made, except for this one and I'm going round in circles with them.

    Credit card statement? Bank statement? When did you buy it - more or less than 6 months ago? This does make a difference.

    Just to add that nobody has been rude to you. You're emotional about the situation but this is about your consumer rights, and they are the same whether the item is a pushchair or a kettle - emotions and "what might have happened" don't come into it.
