NCP parking fine in Scotland

Hi, I am a little new to this and a lot of the advice concerns England on many of the forums so I would like some advice! I received a parking charge notice of £100 from NCP for the driver dropping a friend off in the car park, the driver stopped only for 14 minutes and did not get out of the car. I understand that they think the driver needed a ticket to stop for this amount of time but I feel like the charge they are asking for is unrealistic and unfair, and I have been reading the other posts on here and see that much of the advice is to not respond to the company. I am extremely worried about doing this incase there are different rules in Scotland or if I am not justified to think I should not need to pay! Am I able to appeal, should I just pay or should i leave it? Please help, and thank you in advance! :)

    There are different rules for Scotland.
    The big difference is that only the driver can be held liable in Scotland.

    To this end it is extremely important that the driver's details are never revealed to anyone.

    So the first thing you now need to do is edit your post above to remove that incriminating evidence.
    It was the driver that stopped the car. It was the driver that needed a ticket. It was the keeper that received the postal parking charge notice.

    There is no place for the word 'I' when describing events on the day.

    The parking companies are known to read forums like this and can use your posts against you.

    Having done that read about how to tackle incidents in Scotland by reading post #1 of the NEWBIES FAQ sticky thread.

    In there you'll find:
    Q - ''I'm in Scotland/NI, so is the advice different?''

    A - IF THE EVENT TOOK PLACE IN SCOTLAND OR NI, WE SUGGEST YOU DO (ALWAYS!) COMPLAIN TO STORE MANAGEMENT IF YOUR PCN IS FROM A RETAIL PARK, BUT DO NOT APPEAL, UNLESS YOUR CAR IS A COMPANY/HIRE/LEASED VEHICLE, IN WHICH CASE, APPEAL AS HIRER/LESSEE (SEE * AT THE FOOT OF THIS POST).

    IN SCOTLAND/NI, CERTAINLY COMPLAIN TO THE RETAILERS, BUT IGNORE THE PARKING FIRM UNLESS YOU GET A CLAIM.

    IN SCOTLAND THIS IS EXCEEDINGLY RARE, AND DEFENDABLE BY A KEEPER, WHO CURRENTLY HAS A FAR MORE PROTECTED POSITION IN LAW THAN AN ADMITTED DRIVER.

    WHEN IGNORING IN SCOTLAND/NI, KEEP ALL LETTERS. DO NOT THROW THEM AWAY, FOR 5 YEARS.
  • Firstly thank you for replying! Do you know if they have some way to prove who was driving? I read that forum and I am a little weary of not doing anything incase it comes back to bite me later on, in your opinion do you think I have reason to refuse paying? Thanks :)

    How on earth can they prove who was driving?
    Even if they had a picture of the driver there is no way they can match that picture to a name.

    Their only hope is that the keeper makes a mistake and discloses that information.

    The advice wasn't to do nothing. It was to ignore the parking company. Was it a retail car park? If so complain to the retailer - being very careful to say that it is the keeper of the car that is complaining.
  • Okay good point. It wasn't a retail car park either, so what exactly should I do as I am rather unexperienced in this! :D Thanks again!

    Do nothing. If you must do something complain to the retail park and get them to cancel it.

  • Thank you! I'll see how it goes then :) Do you know how long it takes for them to get in touch again? I have read some stories about debt collection letters from them, so if I were to receive such letters, again I am just to ignore them correct?
